The President of UOKiK has charged the Glovo platform with misleading consumers, for which there is a penalty of up to 10 percent of the turnover, the Office of Competition and Consumer Protection announced on Tuesday. According to the President of the Office, information about additional fees was not properly displayed on the website.

As added by UOKiK, Glovo is a platform available on the Internet and in the form of a mobile application for ordering products and services, most often food and shopping.

Accusations of misleading consumers

According to the President of UOKiK, Tomasz Chróstny, the entrepreneur should construct the interface in such a way that all key elements influencing the consumer’s decision, especially fees, are visible to him.

“It is unacceptable that important information is only available after scrolling or otherwise hidden. The button for placing an order should not be active until all costs associated with the order are presented to the consumer. with all ingredients, the entrepreneur may mislead consumers” – stressed Tomasz Chróstny, quoted in the press release of UOKiK.

Allegations of the office

In the opinion of UOKiK, the messages provided by Glovo may not correspond to reality or may be provided at the wrong time. “It is only at the final stage of ordering that customers learn all the required costs, i.e. how much they have to pay. As a result, they cannot compare the full prices of dishes when choosing them and are often forced to pay more, although they thought they were choosing a cheaper option price,” it said.

Reservations were also raised about the fact that the button used to place an order was not marked with the legally required information “order with obligation to pay” or equivalent wording. According to UOKiK, the “Confirm order” used by Glovo is not sufficient information for the consumer to know that he is obliged to make the payment at this stage.

“Some of the practices used by Glovo may constitute the so-called dark patterns, i.e. the use of knowledge about consumer behavior on the Internet to influence their purchasing decisions in an unfair way. One of them is drip pricing, i.e. adding previously unannounced additional, mandatory fees,” said UOKiK.

If the allegations of misleading consumers by Glovo are confirmed, the company faces a fine of up to 10 percent. turnover, he noted the office of Competition and Consumer Protection.

Glovo position

We asked the Glovo platform to send a position on the accusations of UOKiK. “Additional fees, such as the cost of delivery or the fee for a small order, are visible at the earliest stages of placing an order. The service fee is a standard practice in the industry, used by companies in Poland and around the world. Our analyzes show that in Poland we are one of the companies which informs users about the service fee at the earliest in the entire ordering process and we maintain full transparency. We are open to further cooperation with UOKiK. We will provide all necessary information regarding the purchasing process, “we read in the reply sent to us.
