The prosecutor submitted applications to the Supreme Court to waive the immunities of judges Łukasz P., Arkadiusz C., Przemysław R. and Jakub I. This concerns an investigation into the so-called hate scandal.
The National Prosecutor's Office provided information about submitting applications to the Supreme Court to waive the immunities of four judges on Tuesday.
“During the investigation into the 'hater scandal', the prosecutor submitted applications to the Supreme Court to waive the immunities of judges Łukasz P., Arkadiusz C., Przemysław R. and Jakub I.” – we read in the published entry.
Investigation into the so-called The hate scandal in the Ministry of Justice is being conducted by a three-person team at the Regional Prosecutor's Office in Wrocław. The investigation covers the period until August 20, 2019.
Charges against judges are 'crucial'
As Anna Zimoląg, spokeswoman for the Regional Prosecutor's Office in Wrocław, said earlier, “the presentation of charges to four judges is crucial for the course of further proceedings.”
” (…)Consequently, on June 28, 2024, applications were submitted to the Supreme Court for the issuance of resolutions allowing judges Łukasz P., Przemysław R., Arkadiusz C. and Jakub I to be held criminally liable. Moreover, On September 9, 2024, a supplementary application was submitted to issue a resolution allowing Judge Jakub I. to be held criminally liable in the scope of an additional prohibited act” – provided by the prosecutor.
She added that applications had been submitted in the case to exclude two judges of the Chamber of Professional Responsibility of the Supreme Court from considering the case and to test their independence. Supreme Court did not accept the request to exclude one of them.
“In connection with the above, the prosecutor asked the Supreme Court to provide information on whether deadlines have been set for examining applications for the issuance of resolutions authorizing the bringing to criminal liability of the remaining judges to whom these applications were addressed and to indicate whether the prosecutor's applications for an examination of requirements of independence and impartiality of judges of the Chamber of Professional Responsibility of the Supreme Court, as well as a request to exclude one of them from hearing the case of Judge Przemysław R. – said Zimoląg.
The prosecutor added that “numerous procedural activities are still being carried out to verify all circumstances revealed in the investigation, as well as to assess the possible criminal liability of subsequent persons.”
Hater affair
Investigation into the so-called The hate scandal was initially investigated by the District Prosecutor's Office in Warsaw, later by the Regional Prosecutor's Office in Lublin, and then transferred to the District Prosecutor's Office in Świdnica.
“Since the proceedings were taken over by the Regional Prosecutor's Office in Wrocław, numerous procedural activities have been carried out, resulting in significant progress in the investigation. Particular attention should be paid to the fact that the decision to present charges was announced to the suspect Emilia S. and she was interrogated as a suspect, and during the indicated activity the suspect provided explanations ” – reported Zimoląg in November 2024.
In 2019, the media revealed the so-called hater scandal involving, among others, judge Łukasz P., informing that since June 2018 he had been coordinating an action aimed at discrediting judges who opposed changes in the justice system implemented by the then Minister of Justice Zbigniew Ziobro.
A member of the hate group was, among others, P.'s subordinate, judge Tomasz Szmydt, working at the Ministry of Justice at that time, judge of the Provincial Administrative Court in Warsaw.
The prosecutor's office also recalled that Tomasz Szmydt is wanted on an arrest warrant, which the Regional Prosecutor's Office in Wrocław issued on September 9, after the District Court for Wrocław-Śródmieście decided to temporarily arrest Szmydt for 30 days from the time of his arrest.
An application was also submitted to the District Court for the issuance of Tomasz S. European Arrest Warrant.
In September 2022, in the report “Superwizjer” TVN “Confession of Little Emi. Behind the scenes of the hater scandal”, Emilia Szmydt, called Little Emi, decided to talk about her role in the scandal in front of the camera for the first time.
