On Wednesday, the Senate did not table any amendments to the bill that abolishes tolls for passenger cars on state highways and introduces a ban on overtaking trucks on expressways. The project was prepared by the Ministry of Infrastructure. The bill will now go to the president’s desk.

73 senators voted for the bill without amendments, none voted against, and eight people abstained from voting.

Amendments to the Motorway Act – details

The provisions of the Act amending the Act on Toll Motorways and the National Road Fund and some other acts abolish tolls for using state highways, which are paid by drivers of vehicles with a maximum permissible weight not exceeding 3.5 tonnes (i.e. passenger cars and motorcycles).

However, the fee will still be charged by the Head CASH from motor vehicles with a maximum permissible weight of over 3.5 tons and buses traveling along these motorway sections. Currently, toll sections of state motorways are A2 Konin – Stryków and A4 Wrocław – Sośnica.

Overtaking of trucks is prohibited

The amendment also introduces a ban on overtaking trucks on expressways. It contains a record that allows such a maneuver, provided that the vehicle being overtaken is “moving at a speed much lower than the speed limit”. According to the Ministry of Infrastructure, which was responsible for drafting the bill, it will be 10 km/h difference between the overtaking truck and the overtaking truck. As explained in the justification to the government draft, the provision prohibiting overtaking of trucks is intended to limit behaviors that are negative in terms of road safety, i.e. blocking the left lane and exceeding the speed limit on motorways and expressways by truck drivers. According to the justification, the purpose of abolishing tolls for state motorways is to maintain or increase the communication possibilities of citizens and to reduce the actual expenses incurred by drivers of passenger cars. According to the estimates of the Ministry of Infrastructure, as a result of the resignation from tolling motorways from passenger car drivers, revenue from tolls will decrease by approx. PLN 200 million annually, which is approx. 2.5 percent. revenues of the National Road Fund. The bill will now go to the president’s signature. The Ministry of Infrastructure hopes that the new regulations – in accordance with the regulation – will come into force on July 1 this year.
