The Select Committee investigating the Jan. 6 Capitol riot voted 9-0 Wednesday to approve a legal contempt of Congress decision towards Trump-era Division of Justice official Jeffrey Clark after he defied the committee’s subpoena.

The vote comes because the committee plans to carry a second listening to for Clark on Saturday earlier than the contempt cost is finalized, which is able to present him with a chance to plead the Fifth on a question-by-question foundation.

Clark’s lawyer, as famous by Axios, despatched a letter to Rep. Bennie Thompson, D-Miss., the committee’s chair, and said Clark is “asserting his rights towards self-incrimination beneath the Fifth Modification to the U.S. Structure.” Thompson reportedly conveyed to Clark’s legal professional that the committee could be “keen to convene one other deposition.”

“We won’t finalize this contempt course of if Mr. Clark genuinely cures his failure to adjust to this subpoena this Saturday,” said Rep. Liz Cheney, R-Wyo.

If finalized, the measure could be despatched to the Home for a full vote after which referred to the Justice Division for prosecution of Clark, who served as Assistant Lawyer Common for the Setting and Pure Assets Division from 2018 to 2021.

Earlier this month, Steve Bannon, a former adviser to former President Trump, was indicted on contempt of Congress expenses.

Clark was subpoenaed by the committee in October in an effort to grasp his position “on the Justice Division and study who was concerned throughout the administration” because it pertains to the occasions of January 6.
