Immunity of Mariusz Błaszczak. Motion to repeal

The content of the justification for the request to waive Mariusz Błaszczak's immunity was obtained by TVN24 reporter Agata Adamek. As she said, it accuses Błaszczak that, as a result of his actions, General Tomasz Piotrowski “feels humiliated” and that “trust in him has been lost.” The justification for the request also states – the journalist pointed out – that the former head of the Ministry of National Defense, through his colleague, “demanded the general to make a statement which, in the general's opinion, violated state secrets.”

A motion to waive the immunity of the former head of the Ministry of National Defense has been submitted to the Sejm Mariusz Błaszczakand currently the head of the parliamentary club PIS. This is a private indictment of the former operational commander of the armed forces, General Tomasz Piotrowski, who refers to Article 212 of the Penal Code regarding public insult.

The case concerns a Russian missile that fell in a forest near Bydgoszcz in December 2022 and was discovered by accident only a few months later. Błaszczak then accused the general of not informing him in December that a Russian missile had entered Polish airspace.

The TVN24 reporter reached the conclusion

TVN24 reporter Agata Adamek reached the request to waive Błaszczak's immunity.

As she said, it was sent by the general's representative, and the justification for the document is “very impressive.” – The justification for this request includes details of that time, i.e. April 2023, when it came to light thanks to an outsider that a Russian missile fell into Poland – she said.

She pointed out that General Piotrowski's representative describes in detail the events at that time and explains that the application concerns the conduct of Mariusz Błaszczak, which “could have humiliated General Piotrowski in public opinion and exposed him to the loss of trust needed to hold the position of operational commander of the Armed Forces by accusing, that Lieutenant General Tomasz Piotrowski did not properly fulfill his duties.

– On the following pages of this justification we read, among other things, that the general feels humiliated, that trust in him has been lost thanks to the words of the Minister of National Defense, that his colleagues asked about this matter – said Adamek.

She noted that the military officer “was actually asked about his credibility, asked why he did not inform if he knew about something that happened in December, as Mariusz Błaszczak suggested.” She also recalled that the then head of the Ministry of National Defense argued that “the general is responsible for not providing information that he knew about all this.”

Meanwhile – the journalist reported – “in the justification for the application we read that the only thing that was known was that a signal detected by radar was recorded in Poland, i.e. radar echo, wave reflection from atmospheric phenomena.”

– And that was all that was known in December. So it was not known that a Russian missile had entered Poland. Therefore, all the messages from Mariusz Błaszczak saying that the general knew about everything but did not inform him and that now Mariusz Błaszczak intended, as he said then, to apply for consequences against the general, were not true – she continued.

According to Adamek, the document also tells us what steps Błaszczak was taking at that time. – Well, he sent his collaborator to General Tomasz Piotrowski. A co-worker who (…) went or contacted General Piotrowski, met him and demanded that the general make a statement which, in the general's opinion, violated state secrets – she said.

– If the general had made the announcement that Mariusz Błaszczak wanted, he would have broken the law because it would have violated secrets that should be protected. The general, of course, did not decide to do so, and he informed the National Security Bureau and the head of the Military Counterintelligence Service about the whole matter, about the request to make such a statement, and the head of the Military Counterintelligence Service, who – according to what I read here – confirmed that General Tomasz Piotrowski cannot make this statement, because it will simply break the law – she explained.

– Then there were further steps, which consisted in blackmail by the Minister of National Defense Mariusz Błaszczak against Tomasz Piotrowski. Because the minister allegedly said, among other things, that if the general did not make this announcement, he would be in trouble. So I guess it should be understood as a threat from the Minister of National Defense – she added.
