– We all imagined that changes in the justice system would take place more dynamically – admitted judge Igor Tuleya in “Tak jest”. He added that he was “disappointed”. The President of the Supreme Bar Council, Przemysław Rosati, commented on the amendment to the Act on the National Council of the Judiciary, saying that “the amendment in the Senate is a mistake.”

– We probably all imagined that these changes in the justice system would take place more dynamically – said Tuleya. He admitted that there is “a little impatience.”

– It seems that the Minister (of Justice, Adam) Bodnarand those reformers who took up the task of repairing the justice system still enjoy the trust and support of the judicial community and, I believe, the legal community – he added.

As he noted, “only a few months have passed.” But – he said – “indeed, we believed it could be done quickly.” – Professor Bodnar appeals for patience. We'll see whose strategy turns out to be right, said the judge.

Tuleya: I'm disappointed

Tuleya also talked about the amendment to the Act on the National Council of the Judiciary and the amendment introduced by the Senate. It was met with strong criticism from legal and judicial circles. They argue, among other things, that granting passive voting rights to the Council to neo-judges – i.e. those elected by the neo-National Council of the Judiciary – is unacceptable.

As the guest of “Yes it is” said, “it seems that over the last few years the position of the legal and civic circles, and of people who today hold the most important positions in the country, has been similar.” – We had reservations about neo-judges and believed that such people were not really judges. They submitted to a defective procedure before a body that is not the National Council of the Judiciary, as referred to in the constitution, he pointed out.

In his opinion, “it is a mistake that no serious attention has been paid to this problem so far.” – Judgments issued by such people are simply annulled. I myself think that several cases have been referred for re-examination because they were decided by people who are not actually judges, Tuleya said.

– I think I'm disappointed. It seems that, in fact, changes in the justice system and ideas on how to do it are ready. For example, my judges' association, Iustitia, has prepared draft laws. All you really need to do is reach for it. In our proposals, we deal with the justice system as a whole, he said.

Rosati: the amendment in the Senate is a mistake

Rosati emphasized that “we expect effectiveness and consistency from politicians.” – If we were to focus on this story regarding the amendment to the Act on the National Council of the Judiciary, we must start from this fundamental issue: this is an Act in the interest of citizens. This is not an act in the interest of the legal community or the judicial community, he said.

The idea is to ensure that “there is no situation where judgments will be overturned.” – People expect efficient and effective justice. So, contrary to all appearances, this is not some abstract act, but an act that actually has a direct impact on what proceedings in Poland look like and what are the effects of judgments issued by judges – he pointed out.

He also said that “the amendment in the Senate is a mistake.” – For me this is a completely inconsistent action – he admitted. According to him, the Senate amendment “de facto changes the essence of this project 180 degrees.”
