Judge Robert Grześ reminded in the justification of the judgment that in addition to the tragic effect of the accident in the form of the death of two people, the property was also destroyed in large size in the form of rolling stock and railway infrastructure for a total amount of nearly PLN 8 million.
– In support of the indictment, the prosecutor presented extensive evidence. The accused did not confess to the alleged act. He stated that the reason for this accident were difficult road conditions at this railway crossing. On the one hand, the prevailing fog was to limit the accused the possibility of observing the oncoming train, and secondly, the icing of this journey was to be immobilized by the truck, which was driven by the accused – said the judge.

He added that the conducted court cord clearly showed that the accused led to an accident. He pointed out that the accused's fault was spoke, among others An expert opinion, who precisely reconstructed the course of the incident, and the testimony of the witness who was observed by the traveling train. The expert's opinion was additionally confirmed by the applications from the report of the railway accident examination committee.
– The act of the accused consisted primarily in ignoring the B-20 stop sign and not keeping, only entering the railway crossing directly under the oncoming train. It should be remembered that the accused had an obligation, just like on every driver of the vehicle, primarily to observe the road situation. This is a much broader obligation than just observing the foreground of driving and indicating measuring devices in the car. The driver should take into account the whole situation on the road, i.e. traffic, the surface of the surface, the place where he drives this car – the accused disregarded – the judge noted.

An accident at the crossing
