The prosecutor's decision to investigate Małgorzata Manowska's case gives me the feeling that the Polish state is acting as it should, Przemysław Rosati, president of the Supreme Bar Council and judge of the State Tribunal, told TVN24. He added that he has “two hypotheses” as to why Manowska is not calling a session of the State Tribunal, which is the subject of the case and the basis for the accusations of obstruction by judges.
The National Prosecutor's Office initiated investigation into the failure to fulfil obligations by Małgorzata Manowskachairwoman of the State Tribunal and first president of the Supreme Court. This concerns the failure to convene a full session of the Tribunal within the time limit specified in the regulations – the prosecutor's office explained. This happened after notifying the judges of the Tribunal.
One of the informants was attorney Przemysław Rosati, president of the Supreme Bar Council, judge of the State Tribunal. On Tuesday, he was a guest on “Rozmowy Piaseckiego” on TVN24.
When asked whether the prosecutor's decision gave him satisfaction, he replied: – It gives me the feeling that the Polish state is acting as it should when a public official does not comply with the law.
He assured that the motion to convene the session was complete, contained the established agenda and “everything was as required by the regulations and the Act on the State Tribunal”. – The motion we submitted is formally correct, because – firstly – it came from authorized persons, and secondly – the number of people who signed was sufficient. Thirdly – there was a draft agenda. What is important, there is no regulation that obliges us to prepare a justification – he noted.
Rosati: I have two hypotheses
He said he had “two hypotheses” as to why Manowska was refusing to convene the meeting. “One is that for reasons that are completely incomprehensible to me, someone decided to get their way. Here, of course, I am thinking of Ms. Manowska. This is some kind of wrestling match, an attempt to show who is the leading person,” Rosati said.
– And the second issue that, in my opinion, resonates, taking into account Ms. Manowska's statements and actions to date, is a desperate attempt to maintain the competences she holds – he added.
As the attorney said, “Ms. Manowska has the perfect moment today to convene this meeting and keep her fingers crossed that it may influence the assessment of her conduct in the context of the proceedings conducted by the prosecutor's office.”
