Information about the alleged introduction of a marriage ban among the same sex couples in Italy caused a lot of emotions – but in fact nothing was banned. Single marriages in Italy have never been legalized.

Not marriage, but partnerships

In Italy, only a woman with a man can include a marriage. This is what art. 143. Italian Civil Code: “By marriage, the husband and wife acquire the same rights and take on the same obligations.”

However, in this country there is another form of institutionalization of the relationship between two people: a partnership. This was introduced in 2016 after July 21, 2015, the European Court of Human Rights in Strasbourg he condemned Italy for not recognizing partnerships. He ruled that Italy is required to ensure the possibility of legal recognition of the same sex couples. The Italian Parliament adopted the Act of May 20, 2016 (it entered into force on June 5) known as Cirinna Act – From the name of Monika Cirinnà, a senator who offered her. In the first article of this Act we read:

This Act establishes partnerships of the same sex as a special social formation in accordance with art. 2 and 3 of the Constitution and regulates the actual joint residence.

To include such a relationship, the couple must submit a statement at the Registry Office. Then such a statement must be registered in the archive of marital status. In addition, people entering the partnership must be at least 18 years old and must be free (not to be in another civil relationship).

Thanks to the conclusion of a partnership, the homosexual couple gain such rights as The right to visit a partner in prison, the right to visit, care and information about the partner's health when he arrives in the hospital. In addition, couples of the same sex have rights regarding inheritance issues, e.g. inheritance of property after the death of a partner or the right to a survivor's pension.

However, it should be remembered that the partnership is not synonymous with marriage. What is the most different in Italy is the fact that couples who remain in a partnership are not obliged to follow the obligation to be loyalty, and also cannot undertake the adoption process. And it is the issue of adoption of children that raises the greatest controversy regarding the legalization of relationships between people of the same sex – also in Poland. And the partnership in Italy is not concluded in the church, but in the office.

Portal Pazienti.it He estimates that the partnership is “the only legal instrument that allows homosexual couples to conclude a civil union, because same -sex marriages in Italy are not allowed.”

Conservative power in Italy

The post quoted at the beginning misleads because he talks about marriage of the same sex. And those in Italy were never legalized. We did not get to any information that the Italian authorities were planning to change it.

Giorgia Melonswhich has been the prime minister of Italy since October 2022, is a politician with conservative views. She talked against the marriages of people of the same sex and adoption of children. “Melons came to power as a defender of traditional Christian values and condemning what he calls' gender ideology 'and' lobby lgbt '' – he assesses Reuters. In 2023, she ordered the Milan City Council to stop registering children of the same sex parents. Such adoption is not recognized in Italy, but due to unclear regulations in this matter, in some cases, the courts issued permission for it.
