The president of the Constitutional Tribunal Bogdan Święczkowski announced that from his notification, the deputy general prosecutor Michał Ostrowski initiated an investigation into the “coup d'état” that the rulers would commit. Jarosław Kaczyński commented that “he adopted this initiative with satisfaction.” Prime Minister Donald Tusk reacted to this.
Bogdan Święczkowski informed on Wednesday afternoon that at the end of January he signed a 60 pages of a justified suspicion of committing a crime by the Prime Minister, Ministers, Speaker of the Sejm, Speaker of the Senate, MPs and senators of the ruling coalition, the president of RCL, some judges and prosecutors.
In his opinion, the crime is that these persons “act in an organized criminal group, and in short intervals of time (…), aimed at changing the constitutional system of the Republic of Poland and acting to achieve or stop the activities of the Constitutional Tribunal and other constitutional bodies, In this National Council of the Judiciary and the Supreme Court. ” He added that it was a crime of a “coup.”
He also said that due to the importance of notification and suspected persons, including Prime Minister Tusk and the head of MS Adam Bodnarhe applied for the investigation to be personally conducted by the deputy prosecutor general prosecutor Michał Ostrowski. – Yesterday I was questioned by the prosecutor as a notifying nature – said Święczkowski. He added that on Wednesday he was informed by prosecutor Ostrowski that an investigation was initiated after this notification.
Kaczyński: I accepted Święczkowski's initiative with Satysafacja

“I am satisfied with the initiative of the President of the Constitutional Tribunal and the fact that the investigation was initiated by the Deputy Prosecutor General on the basis of a notification of a justified suspicion of a coup.” – wrote Kaczyński. He stated that he himself repeatedly pointed to art. 127 of the Penal Code, “because this is how you should qualify the unlawful acquisition of public media, the national prosecutor's office, preventing the functioning of the Constitutional Tribunal and the National Court Register, and a number of other, explicitly breaking the law and constitution, actions.”

Together, they submitted a notification, which became the basis for the initiation by the Regional Prosecutor's Office in Warsaw an investigation into the exceeding of entitlements by public officials, including the Minister of Justice – the Prosecutor General, by taking unlawful actions aimed at dismissing Dariusz Barski from the function of the national prosecutor. At the end of December, Prosecutor General Adam Bodnar directed three of his deputies – Ostrowski, but also Robert Hernand and Krzysztof Sierak – to work in the branches of the National Prosecutor's Office.
