Jarosław Kaczyński on moral compromise and the Constitutional Tribunal's judgment on abortion

We need to try to build a compromise in moral matters between conservative and liberal thinking, argued PiS president Jarosław Kaczyński in an interview for “Tygodnik Solidarność”. Stressing that Law and Justice does not want to give up its views, the PiS president assured that in his opinion the state should not interfere too much with people's privacy.

Interviewer with Jarosław Kaczyński he noted that in his opinion Law and Justice so far, it “came up to the elections with various ideas, which it later implemented.” Now – as the journalist noted – “he doesn't see such ideas.” Therefore, he asked the president of PiS whether it was time for a “brainstorming session” and “what needs to be invented in 2024.”

“It is a huge challenge, but we must at least try to build a compromise in moral matters between conservative and liberal thinking. Of course, we do not want to give up our views,” Kaczyński replied.

He referred to the decision of the Constitutional Tribunal on abortion. “On the other hand, we realize that the state should not interfere too deeply with people's privacy. We are aware that the decision of the Constitutional Tribunal on abortion violated this feeling and that is why it caused such strong opposition,” he argued.

October 22, 2020 Constitutional Tribunal ruled that the previously permitted abortion in the event of fetal damage or defects is unconstitutional. This judgment negated the abortion compromise reached in the 1990s. As part of the protest, thousands of citizens took to the streets of Polish cities, supported by organizations uniting supporters of access to abortion.

Kaczyński's latest statement to “Tygodnik Solidarność” contradicts his previous statements. In 2021, a year after the Constitutional Tribunal issued its judgment, the PiS president assured in an interview for “Wprost” that the Tribunal could have issued a harsher judgment. “In my opinion, nothing that would threaten women's interests has happened,” he commented.

He added that there was still a “door” in the possibility of performing an abortion. “I know that there are advertisements in the press that every person of average brain understands and can arrange such an abortion abroad, cheaper or more expensive,” Kaczyński claimed.

In turn, last year, the president of PiS claimed in another interview that abortion can be performed “almost on every corner in Warsaw and in many different places“Then MPs and activists working for women's rights did not agree with the politician's words, pointing out the threat to women's safety and health.

Kaczyński: “Many supporters of building a compromise”

In an interview for the weekly, Kaczyński also maintained that in the PiS structures there are “many supporters of building a moral compromise”. “There are also supporters who are much more radical than me. But there are also many opponents. Interestingly, also among young politicians. We will somehow reach an agreement with each other. The real problem is reaching an agreement with the other side, because I don't know if they are interested in compromise. Perhaps a time will come when such a compromise will be possible,” he said.

Kaczyński did not indicate what specific issues could be included in the compromise. In another part of the interview, he stated that “the ability to end the divisions that have arisen in Poland” was to be one of the criteria for selecting the PiS candidate.
