Judge Beata Morawiec, president of the “Themis” Judges’ Association, referred on Monday on TVN24 to the planned changes in the judiciary announced by PiS president Jarosław Kaczyński. – If such a huge structural reform of the judiciary does take place, then for the next two years the citizen will not have the right to a court. After all, these are not changes where the judge will move from room to room – she assessed.

Jarosław Kaczyński spoke on Saturday in RMF FMthat the committee he chaired approved several months ago draft changes to the judiciary. As he assessed, “this anarchy that prevails in Polish courts today must be mastered”. – And it is necessary to liquidate those institutions that have completely failed, and the Disciplinary Chamber [Sądu Najwyższego – red.] it did not work – he assessed. The deputy prime minister and PiS leader said that “all courts will have the status of district courts.” He stated that “there will be a transfer of the cassation appeal to the level of large regional courts”. – And we’ll have a Supreme Court. It will be a small court whose task will be to organize the jurisprudence – he added.

– If such a huge structural reform of the judiciary does take place, then for the next two years the citizen will not have the right to a court. After all, these are not changes where the judge will move from room to room. These are organizational changes. Huge organizational changes. Liquidation of three levels of the judiciary, reducing them to two. In a situation of complete liquidation, as politicians announce, of district courts when changing the jurisdiction, as I understand it, and the local and substantive jurisdiction of all cases, the time of the proceedings, which is already very long, will be calmly extended by another year – she stated.

She was also asked about the changes in the judiciary to date. – It cannot be denied that it was not a reform. All the changes that have been introduced, that is, the changes to the procedures, both criminal and civil, where the multi-person panels were liquidated, where judges were allowed to adjudicate in the so-called parallel complaints, i.e. at the level of the same court, where they actually only led to total chaos. Lack of employees, bad organization of work, not structure leads to what is happening now. These planned changes, which are known to us to a very small extent, because we only know as much as we hear from the media, will not do anything good for the citizen. They will only allow the minister to verify the judges, or possibly transfer them to the other end of Poland as part of repression, as the minister is currently doing with prosecutors, she assessed.

Morawiec about the Supreme Court

The judge in an interview with TVN24 assessed that this is a way for them to “judge their own”. – This is a tragic announcement. There is no greater value for a citizen than an independent judge, an independent court, she said. – At some point, each of us will have to meet with this court. Whether in an inheritance case, a family case, or in various civil cases – she added.

– We are going back to the times of deep communism, to the times of Stalinism, to the post-Stalinist times, where the role of the Supreme Court was to interpret the law, the legal interpretation of the law that was binding on judges, so now we will have at this small supreme court, probably composed of only people appointed by illegally the National Council of the Judiciary appointed by persons who will dictate to judges how to adjudicate, Morawiec assessed.

– We fought for over 30 years, not to say more, for the judges to be independent. We are going back to the Stalinist and post-Stalinist times again – she said.
