The Prime Minister, at the request of the Minister of Justice Adam Bodnar, appointed Judge Dariusz Mazur to the position of Undersecretary of State at the Ministry of Justice – the ministry announced on Friday.
The announcement on the website of the Ministry of Justice states that Dariusz Mazur will supervise common and military courts and legislation regarding the court system.
Dariusz Mazur is a judge of the District Court in Kraków. For ten years he was the chairman of the 3rd Criminal Department of this court, and also served as its coordinator for international cooperation human rights in criminal cases. He is a legal expert and lecturer as part of the “Linguistics” educational program organized by the European Justice Training Network (EJTN). Previously, he was a lecturer at the National School of Judiciary and Public Prosecution for seven years. He is the author of many publications in Polish, English, German and Czech.
In 2016, judge Dariusz Mazur was honored with the title of “European Judge 2015” for justifying the decision declaring the inadmissibility of extradition to the USA Roman Polanski. In 2020, he was awarded the Badge of Honor of the Association of Polish Judges “Iustitia” for activities related to presenting the current situation of the Polish judiciary in the world.
Mazur is vice-president and spokesman of the Association of Judges “Themis”.
Disciplinary for criticism of the First President of the Supreme Court
The judge received disciplinary charges for criticizing the First President of the Supreme Court Małgorzata Manowska.
These are two interviews that Judge Mazur gave to the Onet portal in July 2021. He alleged, among other things, failure to fulfill her duties by Małgorzata Manowska, claiming that she had not implemented the judgments of the European Court of Justice of July 14 and 15, 2021, which found the Disciplinary Chamber of the Supreme Court to be illegal and ordered the freezing of its activities. Manowska commented in August that she “personally does not agree with the judgment of the CJEU of July 15 or the decision of the vice-president of the CJEU of July 14.”
“Ms. Manowska is helping our pseudo-Constitutional Tribunal in unconstitutionally changing the system of our country. She has a hand in a legal crime”, “In the future, when the rule of law returns to Poland, this lady should not be allowed to hold positions in any profession of public trust. No she should be a judge, lawyer, prosecutor. There is no place for her in the administration of justice after this incredible decision regarding the Disciplinary Chamber. What she did is simply a massacre,” said Judge Mazur, among others, in July 2021, commenting on Manowska’s actions.
On October 5, 2023, the position of judges of common and administrative courts in connection with the ongoing disciplinary proceedings against Judge Mazur was published on the website of the Association of Judges “Themis”.
“Judges of common and administrative courts – out of concern for respecting the constitutional principles of a democratic state of law – would like to point out that disciplinary proceedings conducted under the Act of July 27, 2001, Law on the System of Common Courts, should not constitute a tool limiting the freedom of expression of every citizen, even if he serves as a judge,” we read, among other things.
The judges expressed “full solidarity and support” for the judge who “actively participates in the public debate on the judiciary, presenting the voice of the judicial community.”
