– The greatest tragedy in this situation is that we are dealing with such an institutional pathology, quite cleverly constructed – said Professor Maciej Gutowski in “Fakty po Faktach”, speaking about the scandal surrounding the Justice Fund. – It will certainly be verified whether his intentions were actually aimed at clarifying matters – said Dr. Łukasz Chojniak from the Department of Criminology and Criminal Policy at the University of Warsaw regarding Tomasz Mraz.

Since last week, the media, including tvn24.pl, have been publishing tapes that were recorded over the last two years by Tomasz Mraz – former director of the Justice Fund Department at the Ministry of Justice. They concern the functioning of this particular fund.

Mraz is one of the suspects in the investigation into irregularities in the awarding of million-dollar grants from the fund, described as the “key witness” in the case who is “slandering the gangsters.” Zbigniew Ziobro and his support from Sovereign Poland managed the Ministry of Justice and the Justice Fund itself for years.

AFRAID AROUND THE JUSTICE FUND

The case was commented on by the guests of “Fakty po Faktach”, lawyer, professor Maciej Gutowski from the Adam Mickiewicz University in Poznań and doctor Łukasz Chojniak from the Department of Criminology and Criminal Policy of the University of Warsaw.

According to Maciej Gutowski, “the greatest tragedy in this situation is that we are dealing with such an institutional pathology, quite cleverly constructed.” – We have the Minister of Justice who, on the one hand, as a representative of the government administration, decides – or the officials subordinate to him – decide on the spending of public funds. Secondly, as the prosecutor general, he decides whether or not to prosecute crimes, he continued.

– As the Minister of Justice, he initiates legislative processamong others, the one who expands the circle of institutions having access to the Justice Fund and, finally, as the head of the coalition party, on the one hand, is interested in obtaining funds for the (election) campaign, and on the other hand, participates in the legislative process and co-decides on its final shape – added.

– In short, the combination of all these functions in one hand, combined with the process of essentially destroying the justice system in recent years, causes such a feeling of institutional impunity. As long as the cards remain in one hand. And this makes it very easy for people operating within the ministry to commit crimes, said the lawyer.

Chojniak on the “bigger problem”

Doctor Łukasz Chojniak from the Department of Criminology and Criminal Policy, University of Warsaw, was asked about the evidentiary value of the recordings provided by Tomasz Mraz. – This is actually one of many pieces of evidence that can be admitted in court and will probably be admitted, because I have no major doubts about the fact that it will end up in court – he replied.

The guest of “Fakty po Faktach” pointed to a “bigger problem”, which may be the character of Mraz himself. – The main character, who is the author of these recordings, without taking anything away from his intentions, but nevertheless, was a participant in the whole procedure – he said.

As he added, “it will certainly be verified whether the intentions that accompanied him were really aimed at clarifying the case, at proving a possible crime, or whether it was about relieving oneself, taking some of the burden off oneself.” responsibility and share it with others.

– Regardless of the fact that someone comes to the right conclusion that they want to cleanse themselves and quit their criminal activities, it cannot be that this person appears and we suddenly forget about what happened in their past – he said.

– The point here – regardless of the heat of political discourse, since we are talking like lawyers – is to make it clear that these matters must be assessed with a certain distance, because in fact everyone here also has their own interest. This is not a person completely uninvolved in the case who accidentally witnesses a crime and reveals it, but a person who took part in it, Chojniak noted.
