None of the entities summoned for reimbursement of subsidies from the Justice Fund returned the money – said the Ministry of Justice. The ministry stated that enforcement proceedings are possible in the future.

“None of the entities called for a refund of the subsidy returned the money,” he said Ministry of Justiceadding that it has not yet issued administrative decisions to return the subsidies collected. According to the ministry, the amount of undue subsidies is a total of almost PLN 90 million.

At the end of March, the head of the Ministry of Justice, Prosecutor General Adam Bodnar called on eight entities, including the Profeto Foundation and the Fidei Defender Association, to return money from the Justice Fund. The ministry emphasized at the time that the previous authorities of the ministry he managed Zbigniew Ziobrothey granted money to these entities, despite the fact that they “did not meet the required criteria or were to be intended for purposes different from those that the fund was to finance.”

Decision to return funds, later enforcement proceedings

The ministry also announced that the procedure provides that if the contractor does not return the funds as requested, the decision to return funds will be issued as part of the administrative procedure. “The administrative decision specifies the amount and deadline for returning the funds. The contractor has the right to appeal against it. If the decision is upheld and the further failure to return the funds, the next step is to conduct enforcement proceedings to regain funds,” the ministry said.

The summoned entities were to return the money to the justice fund account within 15 days of receiving the request for payment.

According to the Ministry of Justice, in accordance with the Public Finance Act, the control is a formal basis for applying for a refund of undue public funds, and in the case of its absence, to seek liabilities in legal means.

“The amount to be refunded was determined on the basis of a meticulous analysis of documentation, reports, bank statements, as well as subsidy settlement reports. The control served to verify whether and on what scale the budget of the Justice Fund budget in previous years was implemented contrary to procedures” – MS said.
