The prosecutor’s office has sent an indictment to the court in the case of the rape and murder of a 30-year-old woman who was found over a year ago under a garbage shed in Koszalin (West Pomeranian Voivodeship). According to the prosecutor, a 48-year-old resident of the city is responsible for the crime. The woman was an acquaintance of his son.

The District Prosecutor’s Office in Koszalin filed an indictment against Andriej K. to the District Court in Koszalin. According to the spokesman for the District Prosecutor’s Office, Ryszard Gąsiorowski, the 48-year-old is accused of on the night of March 13/14, 2022, in a garbage shed at Moniuszko Street in Koszalin, he raped and killed 30-year-old Maria P.

– He punched her in the face, knocked her to the ground, choked her, led to sexual intercourse with violence, while at the same time to numerous bodily injuries. The victim died as a result of a hemorrhage into the respiratory tract, she choked on her own blood, said prosecutor Gąsiorowski.

Unreliable testimony

The body of a 30-year-old Ukrainian woman, Maria P., was found on March 14, 2022 in a garbage shed at ul. Moniuszko. The police arrested three people in the evening of the same day – a 33-year-old woman and two men aged 40 and 47. The first two were eventually questioned as witnesses and released home. Andrei K. was detained.

Defendant – citizen Ukraine He pleaded not guilty to the charges against him. – He only confirmed that he knew a 30-year-old woman who had lived and worked in Koszalin for several years. It was an acquaintance of his son who is in Ukraine. She was supposed to help the defendant in official matters, in sending money earned in Poland to his son. He confirmed that they saw each other on March 13, but only spoke to each other and parted ways. He claimed that he did not beat her and did not rape her, that someone else had to do it – said Gąsiorowski.

He noted that these explanations were considered by the prosecutor who conducted the proceedings and submitted the indictment to the court as “incredible, contrary to the opinions of experts, testimonies of witnesses and the perpetration is beyond doubt”.

He had beaten to death before

Prosecutor Gąsiorowski added that the evidence was supported by expert opinions in the field of biology, chemistry, genetics, traseology, forensic medicine and forensic analysis of teleinformation data. Andriej K. underwent a psychiatric examination and no disorders that could affect his sanity at the time of committing the alleged crime were found.

The prosecutor’s office also requested the relevant Ukrainian authorities to send data on Andrei K.’s criminal record. They received it and it shows that the 48-year-old was convicted twice for beating to death. The second time, already in recidivism conditions, in 2012 for 9 years in prison. He left the Ukrainian prison in 2019.

– Investigators compared his explanations with the line of defense adopted when he was responsible for crimes committed in Ukraine. Convergence was found in an attempt to simulate the participation of other people in the crime, prosecutor Gąsiorowski said.

They want him to answer like a repeat offender

He noted that the prosecutor’s office, when submitting the indictment to the court, also indicated that it wanted Andrei K. to answer for the murder of Maria P. under the conditions of recidivism. – The prosecutor stipulates that the accused has not been punished in Poland so far, but the district court should take into account that the accused was punished in Ukraine. It refers to the relevant provisions on the mutual recognition of convictions issued by courts in another EU Member State, on the basis of which Polish courts recognize the judgments issued. In the prosecutor’s opinion, there are no obstacles to not taking this previous criminal record into account in the case of the accused Ukrainian, even though Ukraine is just trying to join the EU,” noted prosecutor Gąsiorowski.

Andrei K. has been in pre-trial detention since March 17, 2022. He is facing life imprisonment.
