The court upheld the prosecutor's decision to discontinue the investigation into a road accident involving the former deputy director of the prison service Artur Dziadosz. The basis was the opinions of experts, who assessed that the deadly hit hiking on the lanes was not the fault of the driver.
The investigation into the deadly hit by the former deputy director of the Prison Service Artur Dziadosz lasted five years. In November last year, the District Prosecutor's Office in Lublin issued a decision to discontinue the proceedings. Investigators, based on several opinions of experts, who stated that the hiking at the crossing was not caused by the driver's fault, but the injured.
The daughter of the victim did not agree with such a decisionwhich appealed against the prosecutor's decision. A few days ago it was considered by the District Court in Kozienice. – The court did not take into account the complaint of the victim and upheld the contested order – said Renata Król, vice president of the District Court in Radom.
The pedestrian died on the lanes
The accident occurred on November 4, 2019 in the evening at the marked pedestrian crossing in Kozienice. The then deputy head of SW riding a private Mazda hit an older woman on her belts. The pedestrian died the next day in the hospital. The driver was sober.
Shortly after the accident, the prison service confirmed that the participant in the accident in Kozienice was the deputy general director of SW Col. Artur Dziadosz. The spokeswoman of the SW at the time emphasized that for the deputy director, the Swossen was a personal tragedy. The press release indicated that Dziadosz tried to help the victim and that he was shocked by the information that the pedestrian died in the hospital.
Seven expert expert opinions
The investigation lasted five years. At that time, seven accident expertise was created.
In November, the District Prosecutor's Office in Lublin announced the discontinuation of the investigation in the absence of the features of a criminal act. – The analysis of the evidence gathered in the case did not provide evidence that the driver approaching the pedestrian crossing did not exercise due caution and that he violated other traffic rules that would remain in a cause -and -effect relationship with an accident – explained a spokeswoman for the Lublin prosecutor's office Agnieszka KÄ™pka.
The investigative findings showed that Dziadosz rode as a third in a column of vehicles, which she shared a short distance. – The vehicles preceding him passed through the pedestrian crossing a few seconds in front of him and then the victim stood on the sidewalk before the crossing, passing the column of cars. Then suddenly she decided to get on the lanes – said the spokeswoman.
Analyzing pedestrian behavior, the expert stated that by entering the road directly in front of the driving car, she created a traffic threat. Thus – according to experts – the woman led to the traffic accident. The experts also stated that, given the adverse weather conditions at the time of the accident, the speed at which the driver of the Mazda rode (at the time of deduction of about 48 plus minus 5 km/h) was safe.
