An indictment against 36-year-old Bartłomiej K., who fatally hit a 10-year-old cyclist, was filed with the District Court in Ropczyce (Podkarpackie Voivodeship). The girl cut him off, but the experts concluded that if the 36-year-old had driven at the speed limit – he had 62 kilometers on the odometer instead of the maximum of 50 – he could have avoided being hit.
According to the spokesman for the District Prosecutor’s Office in Rzeszów, prosecutor Krzysztof Ciechanowski, 36-year-old Bartłomiej K., a resident of the Iwierzyce commune, was accused by the prosecutor’s office that in June 2022 in Kozodrza (Podkarpackie Voivodeship), driving a Mercedes truck, he was driving at a speed of 62 kilometers per hour on a stretch of road where the speed limit was 50 km/h.
According to the prosecutor, the driver intentionally violated the safety rules in land traffic and created a road safety hazard for 10-year-old Faustyna N., who was riding a bicycle. caused an accident that resulted in a multi-organ injury to Faustyna.
– In particular, head and cervical spine injuries with skull fractures, brain contusions and intracranial bleeding, as well as chest injuries with lung contusions, which resulted in her death – pointed out the prosecutor.
Experts: if he had been driving at the speed limit, he could have avoided the accident
He emphasized that the investigation gathered extensive evidence, including the opinion of experts in the field of road accident investigations, in the field of medicine on determining the causes of the girl’s death, as well as the institute of forensic expertise on the chemical and toxicological examination of psychoactive substances in the suspect’s body.
– First of all, the opinion of an expert in the field of road accident investigations shows that – although the direct cause of the accident was the maneuver undertaken by Faustyna N. – the suspect’s speeding by twelve kilometers per hour had a direct cause and effect relationship with the accident, where assuming the suspect moving at the prescribed speed, he had the physical ability to avoid the accident by stopping in front of the victim’s crossing track – prosecutor Ciechanowski pointed out.
He has pleaded not guilty to the charge and is facing prison
Bartłomiej K. did not admit to the alleged act and refused to provide explanations.
The man has not been punished so far, and the crime he is accused of is punishable by imprisonment from six months to eight years.
