The trial of 59-year-old Anna K., who drove a car into a cyclist and her three-year-old son, starts before the District Court in Zamość. The woman died and the injured child was taken to the hospital. According to the experts, the 59-year-old woman had 3.5 per mille of alcohol in her blood at the time of the accident. Prosecutors charged her with murder and attempted murder with intent. She is facing life imprisonment for this.

The accident happened on May 28, 2022 on Kościuszki Street in Krasnystaw. The 59-year-old, driving a Toyota, led to a collision with two cars parked on the road, and then hit a 45-year-old cyclist carrying her three-year-old son in the seat.

As the Lublin police reported at the time, the woman driving the bicycle was going in the same direction and could not avoid the accident in any way. After the collision, the car seat in which she was transporting her son landed several meters behind the car.

The 45-year-old cyclist was transported to the hospital in critical condition, where she died after a few days. The boy was also hospitalized. His injuries in the accident were not life threatening.

After the death of the cyclist, the prosecutor changed the charges

Initially, Anna K. was charged with causing a fatal accident, but in the course of the investigation – based on the opinions of experts – the prosecutor decided to change the charges for the possible murder with intent of a 45-year-old cyclist and the attempted murder with intent of her three-year-old sonthat the woman was carrying on her bicycle.

According to expert toxicologists, the 59-year-old woman had 3.5 per mille of alcohol in her blood at the time of the accident. An expert in the field of road accident reconstruction determined that the woman “did not take any action to prevent the event in question, despite the fact that she had objective possibilities to do so”. – She could have passed the cyclist, braked, but she did not take these actions – prosecutor Daniel Czyżewski from the District Prosecutor’s Office in Krasnystaw told us in November last year.

She heard a number of allegations

During the investigation, the woman pleaded not guilty to the charges of murder and attempted murder with possible intent. She only admitted to driving while intoxicated.

Anna K. was also charged with insulting police officers and violating the bodily integrity of a police officer. According to the findings of the prosecutor’s office, the 59-year-old allegedly insulted the police officers who arrived at the scene of the accident, and also pulled and pushed one of them. She also pleaded not guilty to these allegations.

Investigators ruled that she was sane and could be held accountable for her actions

In the course of the investigation, the 59-year-old was examined by two expert psychiatrists. – According to the opinion, the suspect has been diagnosed with alcohol dependence syndrome and a depressive episode. The experts found that the suspect had been able to recognize the meaning and direct her conduct in relation to the alleged acts. She is not an insane person, prosecutor Czyżewski told us.

That is, a woman may be held accountable in court for the actions she was accused of.

Annie K. is facing life imprisonment for her crimes.
