The President of the Constitutional Tribunal, Julia Przyłębska, convened the General Assembly of Constitutional Tribunal Judges for July 20 in order to select candidates for the position of vice-president, judge Krystyna Pawłowicz announced on Twitter on Wednesday. She added that she had submitted her candidacy.

“On July 20, Thursday, at 10.00 am, the President of the Constitutional Tribunal, Julia Przyłębska, convened the General Assembly of Judges of the Constitutional Tribunal. The goal is to select candidates for the position of Vice-President of the Constitutional Tribunal,” Pawłowicz wrote on Twitter on Wednesday afternoon. She announced that she had submitted her candidacy. “Apparently, judge of the Constitutional Tribunal Jakub Stelina will also apply for this function” – she added.

On Wednesday, July 5, Mariusz Muszyński’s six-year term as vice-president of the Constitutional Tribunal expired. He is one of the judges who believe that Julia Przyłębska’s term as president of the Constitutional Tribunal came to an end in December last year.

Dispute in the Constitutional Tribunal

A dispute has been going on in the Constitutional Tribunal for several months about Przyłębska’s term as president of the Constitutional Tribunal, which has recently made it impossible for the Tribunal to convene in full (at least 11 out of 15 judges). According to some lawyers, including former and current judges of the Constitutional Tribunal, Przyłębska’s term of office expired after 6 years, i.e. on December 20, 2022, and at the same time she cannot apply for this function again.

According to Przyłębska herself, as well as Prime Minister Mateusz Morawiecki and some experts, her term of office ends in December 2024 – with the end of Przyłębska’s term as a judge of the Constitutional Tribunal.

In connection with the dispute in the Constitutional Tribunal, a full court decision is still pending, among others, a motion submitted in February by President Andrzej Duda regarding the amendment to the law on the Supreme Court, which – according to PiS politicians – is to enable the implementation of the “milestone” on which the European Union makes disbursement of funds for the National Reconstruction Plan.

All current judges of the Tribunal are appointed by the current ruling majority.
