Piotr O. was steering a boat with three children on board, despite a court ban on driving any vehicles. On Friday, the court sentenced him to four years and three months in prison for causing an accident on Lake Tałty (Warmian-Masurian Voivodeship), which resulted in the drowning of an eight-year-old girl.

The helmsman, Piotr O., was accused of, among other things, intentional violation of safety rules in water traffic and causing a fatal accident. The case received wide coverage not only in Masuria. On June 18, 2022, a boat sank near Stare Sady, but an eight-year-old girl did not survive the accident.

According to the prosecutor’s findings, Piotr O. went on a cruise on a previously rented motorboat that day and drove it, although he did not have the motorboat license required to operate it (the license was valid for two years from November 27, 2020) or knowledge about navigation safety.

A total of seven people were traveling in the motorboat, including three children. At one point, the accused allegedly made an incorrect maneuver in response to waves created by other ships and positioned the boat sideways to the wave, which contributed to the loss of stability of the boat and, consequently, to its capsizing. The people traveling in the motorboat fell into the water, but the boat completely sank.

As a result of this accident, an eight-year-old girl died. Her body was recovered from the sunken boat by rescue services. At the same time, investigators noted that at the time of the incident, the people on board were not wearing safety equipment or life jackets.

He did not admit that he intentionally violated safety rules

The trial of Piotr O. began on October 9, 2023 before the District Court in Mrągowo. On the first day of the trial, the defendant admitted that he had not complied with the ban on driving any motor vehicles and was driving a motorboat without having the required motorboat license.

However, he did not admit that he intentionally violated the safety rules in water traffic and caused the accident. Piotr O. then gave an explanation.

The verdict was handed down on Friday, December 29. The District Court in Mrągowo found Piotr O. guilty of the acts charged and sentenced him to a total penalty of four years and three months of imprisonment. The court also imposed a punitive measure on the accused in the form of a ban on driving any motor vehicles for a total period of 15 years.

The court ordered the defendant to pay compensation for the harm suffered in the amount of PLN 20,000. PLN for both parents of an eight-year-old girl. The judgment in this case is not final.
