The District Court in Warsaw dismissed the prosecutor's complaint about the failure to impose arrest on businessman Leszek Czarnecki – his representative, Roman Giertych, announced on social media. This is a case related to GetBack. The second of Czarnecki's attorneys, attorney Jacek Dubois, said in an interview with tvn24.pl that Tuesday's court decision is no longer subject to further appeals and that there are no grounds to arrest the businessman in this case.

“Just now, the District Court in Warsaw, composed of three professional judges, dismissed the complaint of the Regional Prosecutor's Office against the failure to impose arrest on Dr. L. Czarnecki. The court found that the prosecutor's office did not substantiate his commission of a crime. I am waiting for the immediate discontinuation of the proceedings,” he wrote on Tuesday after in the afternoon on social media, attorney Roman Giertych, one of Leszek Czarnecki's defenders and also an MP from the Civic Coalition.

In the next entry, Giertych added that he “ended the arrest case that lasted 5 years.”

Dubois: Czarnecki cannot be detained in this case

Attorney Jacek Dubois, the second of Czarnecki's defenders, said in an interview with tvn24.pl that in the matter of arrest, the court once again found that the guilt “was not substantiated in such a way that a preventive measure could be applied.” It was about the arrest of Czarnecki, which was demanded by the prosecutor's office.

The lawyer pointed out that Tuesday's court decision is no longer subject to further appeals, and the case related to Czarnecki's possible detention is over.

Does this mean that Leszek Czarnecki, if he appeared in the country, could not be detained in this case? – At the moment, the matter is settled, which means that there are no grounds to apply a preventive measure. So, with the facts unchanged, there is no basis to detain Mr. Czarnecki in this case. He cannot be detained in this ongoing case, Dubois continued.

In his opinion, the whole case was “political in nature” and was “simply an attempt to take revenge for Mr. Czarnecki's actions by revealing certain matters related to Law and Justice.” – This shows that in fact the prosecutor's office has been a tool for private games over the past few years – he added.

Proceedings regarding the GetBack scandal

The investigation into the GetBack scandal was initiated in April 2018, a day after the Polish Financial Supervision Authority submitted a notification. A special investigation team was established. In May 2018, the first searches and security of documents, information media and property were carried out, and in June 2018 the former president of GetBack was detained.

In this case, the prosecutor's office accuses entrepreneur Leszek Czarnecki of fraud to the detriment of over PLN 1.1 thousand. customers of Idea Bank SA in the amount of PLN 227 million and causing significant damage to the bank in the amount of PLN 9 million.

Requests for arrest

In July 2020, the prosecutor's office issued a decision to bring charges against Czarnecki in connection with the scandal, but they were not formally announced to him because the businessman permanently resides abroad. Then the prosecutor filed the first request for arrest against Czarnecki.
