At the Wednesday meeting The Sejm is to deal with a draft amendment to the Broadcasting Act known as lex anti-TVN. August 4 Republican and Democratic US senators issued a joint lex anti-TVN statement on the matter. “The decision to implement such a law may have negative consequences for defense, business and trade relations. We urge the Polish government to consider before taking any decisions that could adversely affect our long-term relationship,” the senators wrote. The position on the changes to the media law in Poland was also issued by representatives of the House of Representatives.

Tadeusz Kowalski said that “there is no legal reason why TVN24 should stop broadcasting”. “I hope that the choice will be kept for the viewers who showed yesterday that you are needed,” he added.

Lex anti-TVN

TVN24 is still waiting for the National Broadcasting Council to extend its license, which expires on September 26. The application for its extension was submitted 18 months ago. KRRiT claims that the problem lies in the “ownership situation” of the TVN group. Meanwhile, a group of Law and Justice MPs submitted a draft amendment to the Broadcasting Act to the Sejm on 7 July. “The will of the legislator is that companies based in Poland cannot be controlled by entities outside the European Economic Area” – it was written in the justification.

TVN is owned by Discovery, through its subsidiary Polish Television Holding BV in the Netherlands, and thus belonging to the EEA.

Commentators agree that the changes are aimed at TVN’s independence.

Management statement

The station’s management wrote in a statement that in 2015 the National Broadcasting Council accepted the entry of American capital into TVN. Since 2016 – under the same ownership conditions – KRRiT has already issued licenses for TVN24 BiS, TTV and TVN International West. Two votes in the National Broadcasting Council took place on July 22nd regarding the license for TVN24. However, no decisions were made.
