Law and Justice deliberately mixes two concepts, sexualization and sex education, said Dorota Łoboda, Warsaw councilor from KO, president of the Parents Have a Voice Foundation, in “Fakty po Faktach” on TVN24. She referred to the civic bill, called “lex Czarnek 3.0”. – This act is an emanation of a lack of trust in non-governmental organizations, which we should rather treat as a resource for the education and support system – assessed Dr. Jędrzej Witkowski, president of the board of the Center for Citizenship Education.

On Friday, the Sejm dealt with the project “lex Czarnek 3.0”. He rejected the opposition’s motion to reject the civic draft amendment to the Education Law Act, described by the ruling majority as “Let’s protect children”. Thus, he opted for further work on this project. It will now go to the Committee on Education, Science and Youth.

According to teachers and experts, this project will limit the presence of NGOs in schools. The previous two Lex Czarnek laws, vetoed by the president, had the same reservations. This time, however, it is not a government or parliamentary project – it is a civic project.

One of the points of the project reads: “Associations and other organizations promoting issues related to the sexualization of children are prohibited in kindergartens and schools.”

The assumptions of the project were commented on in “Faktch po Faktach” on TVN24 by Dorota Łoboda, a councilor of Warsaw on behalf of KO, president of the Parents Have a Voice Foundation, representative of the “Wolna Szkoła” initiative, and Dr. Jędrzej Witkowski, president of the board of the Center for Citizenship Education.

According to Dorota Loboda “Law and Justice deliberately mixes two concepts. – Sexualization, which is evaluating, valuing and perceiving another person through the prism of sexual attractiveness, and sex education, which means something completely different, means imparting knowledge about human sexuality.

– So in fact, PiS allegedly wants to fight sexualization, but in fact it will also fight sex education, because this sexualization is not defined in any way in the act. There is no definition there and as non-governmental organizations, as parental circles, as opposition circles, we see that this law will have a chilling effect, she continued.

She specified that this chilling effect is to be caused “towards female directors”. – Because the minister [edukacji i nauki, Przemysław – przyp. red.] Czarnek says that “we are not against sex education”, “it is in the school curriculum and it will not change”. On the other hand, “we warn against so-called” – as he says – “sex educators”, or rather, in his opinion, corrupters who come to school from the outside and, as I understand it, corrupt – continued Dorota Łoboda.

– It is this tracing paper that is dangerous. This is linking sexualization with sex education organizations, (…). There are no non-governmental organizations or social organizations in Poland, there are no educators in Poland who have the sexualization of children in their goals or activities. There is no such thing. This is a problem invented by Minister Czarnek and his environment – emphasized the president of the Parents Have a Voice Foundation.

Doctor Witkowski: instead of trusting them, we treat non-governmental organizations as a threat

Doctor Witkowski said that the first point of the bill is “a ban on the activities of organizations in primary schools and kindergartens that deal with this ‘sexualisation'”. He explained that “the second point is to formalize the entire cooperation of non-governmental organizations with schools.”

– So this law, first of all, is an emanation of a lack of trust in non-governmental organizations, which we should rather treat as a resource for the education and support system. Organizations supported schools and on the occasion of the Ukrainian crisis, and earlier on the occasion of remote education, and instead of trusting them, we treat them as a threat – he pointed out.

– We are of the opinion that both the headmaster and parents should consent to the participation of their children, especially if the classes are conducted by people from outside the school and, for example, go beyond the content of the core curriculum – continued Witkowski.

At the same time, the president of the Civic Education Center explained that “this project differs from the previous draft amendment to the act in that the role of the probation officer is already very limited”. – The principal is obliged to inform the probation officer that such an organization wants to enter the school, but the probation officer does not have to agree to it. This is replaced by the so-called internal supervision, i.e. it is the headteacher’s responsibility – based on the opinion of the Parents’ Council and the School Council – to assess whether this organization can work with students. And of course, then there is the stage of verification by parents, i.e. parental consent to participate [dzieci w zajęciach – red.] is mandatory, he said.
