The amendment to the Code of Civil Procedure was published on Friday in the Journal of Laws. Extensive changes relate to civil procedures. The amendment also contains a provision amending the rules for publishing adjudicated apologies for infringement of personal rights. For this reason, the act was referred to as Lex Kaczyński.

On Friday, the act amending the Code of Civil Procedure and some other acts was published in the Journal of Laws.

According to the list posted on the website of the Chancellery of the President of the Republic of Poland Andrzej Duda he signed the amendment on March 22. However, it is useless to look for information about the signature of the amendment to the Code of Civil Procedure in “News” – as it happened in the case of the Act on the National Oncology Network or the amendment to the Labor Code.

Politicians and publicists referred to the amendment to the Code of Civil Procedure as Lex Kaczyński, due to the fact that one of the provisions would allow Jarosław Kaczyński avoiding the payment of over PLN 700,000 resulting from the need to publish an apology to a politician of the Civic Coalition Radoslaw Sikorski.

Ultimately, the president PIS took advantage of the offer of the MEP, who proposed that he pay PLN 50,000 to the armed forces of Ukraine.

The act provides that if the defendant fails to publish the apology, the court will be able to order its publication in the publicly available Monitor Sądowy i Gospodarczy at the defendant’s expense. Content may be reproduced by other media. The court may also impose a fine of up to 15,000 on the defendant. PLN fine. The provision also applies to proceedings that are already pending.

Amendment of the Code of Civil Procedure

The amendment passed at the end of January by the Sejm changes, among others, a dispute value threshold dividing cases between district and district courts. Cases where the value of the subject matter of the dispute is less than PLN 100,000. PLN, will be dealt with by the district courts operating in a given district.

There will be a new procedure involving consumers. In such proceedings, the consumer will be able to “also bring an action before the court competent for his place of residence”, and the provisions on proceedings with the participation of consumers will also apply if the entrepreneur has ceased running a business.

The new regulations provide for the reduction of bailiff fees and linking their amount to the actual effects of the bailiff’s work in order to increase creditors’ access to institutions securing monetary claims before or during the proceedings.

The Sejm adopted 26 Senate amendments, mostly of an editorial nature. An amendment was also adopted, obliging the Ministry of Justice to review the functioning of the provisions of this amendment and to provide the Parliament with written information on its effects three years after the entry into force of the amendment.
