Parliamentary majority dismissed the commission members on November 29 for investigating Russian influence, known as “lex Tusk”. Earlier in the day, the committee presented an interim report on three months of its work. In its report, the commission recommended that: Donald TuskJacek Cichocki, Bogdan Klich, Tomasz SiemoniakBartłomiej Sienkiewicz was not entrusted with public positions responsible for state security.

A statement on this matter was issued by Generals Janusz Nosek and Piotr Pytel and Colonel Krzysztof Dusza, who were in the management of the SKW at the time mentioned in the report. Generals Nosek and Pytel were heads of the SKW, Colonel Dusza – deputy head of the SKW, later head of the Counterintelligence Expert Center FOR THIS.

“The report is a document of a purely political, not substantive nature. Its publication, together with the annexes, radically weakens the defense capabilities of the Republic of Poland and the authority of the state in the international arena. The thoughtless and unjustified declassification and publication of documents constituting a state secret, which is nothing other than political interest, creates an unprecedented and a direct threat to the security of the Republic of Poland,” they wrote.

“There was never any actual cooperation between the FSB and the SKW”

Former representatives of the SKW management write that “the thesis about the Military Counterintelligence Service being influenced by the Russian Federation is a lie unsupported by any evidence.” “In the years 2010-2014, when conducting a dialogue with the Federal Security Service of the Russian Federation, the SKW was guided only by the interests of the Republic of Poland, and the information obtained during the dialogue strengthened the security of the State and the Polish Armed Forces. The thesis that it was the FSB as a result of the dialogue with the SKW is justified and has solid factual grounds. was subject to Polish influence,” they continue.

At the same time, they assure that “there was never any actual cooperation between the FSB and the SKW.” They explain that “it could have come into existence only after the Cooperation Agreement signed on September 11, 2013 in St. Petersburg, if the Russian Federation had not tightened its policy at the beginning of 2014 and annexed Crimea.” They add that “contacts that took place in the years 2010-2014 did not require the consent of the Prime Minister, they were established through the Internal Security Agency.”

“The Head of the Military Counterintelligence Service applied to Prime Minister Donald Tusk and obtained his consent to cooperation in December 2011. Since the consent was issued without the opinion of the Minister of National Defense, the Head of the Military Counterintelligence Service applied for it again. After a positive opinion from the Ministry of National Defense, the consent was issued by the Minister with appropriate authorization. Internal Affairs Jacek Cichocki in November 2012,” they added.

“The legal framework for dialogue and signing the Agreement between the SKW and the FSB was created by the agreement on the protection of classified information between the Republic of Poland and the Russian Federation, prepared by the PiS government in 2005-2007, signed in February 2008 by the PO-PSL government, initialed by Lech Kaczyński. The agreement “The one in Article 3 directly indicates the SKW as the competent body responsible for coordinating activities related to its implementation in the military sphere, also indicating the FSB on the Russian side,” they claim.

“The international conditions justifying the signing of the Agreement include the arrangements of the NATO-Russia Group from the Lisbon Summit in 2010 on cooperation mainly in the context of Afghanistan, transit bases in Russia, food supplies to bases in Afghanistan. At the NATO Joint Forces Headquarters in Europe (SHAPE NATO in Mons) there has long been a permanent and numerous Russian representation, and a NATO information office in Moscow. In 2013, the FSB had over 200 agreements with various services around the world, including the FBI since 2011. The Polish civil services (UOP/ABW) have had such an agreement since 1994 year,” the authors of the statement remind us.

Former heads of the Military Counterintelligence Service accuse the commission of presenting a thesis that is a “lie”

Further on, Generals Nosek and Pytel and Colonel Dusza write that “the direct needs justifying the signing of the Cooperation Agreement between the SKW and the FSB are: the presence of Polish soldiers in Afghanistan, cooperation in UN missions, where the Russians were often the framework country, protection of joint military exercises and mutual visits of units under international disarmament agreements.

“The Report’s thesis that the Cooperation Agreement was harmful to the interests of the Republic of Poland also in terms of being in conflict with the Republic of Poland’s obligations towards NATO is a lie. Article 10 of the Agreement, omitted in the Report, states that it does not violate the ‘rights and obligations arising from concluded international agreements’ , which means that the SKW will, first of all, respect the international agreement, i.e. the Washington Treaty. Omitting the content of Article 10 directly indicates manipulation of the disclosed documents,” the authors continue to write.

“It is also a lie to claim that at least 107 meetings of the SKW management with representatives of the FSB took place in the years 2010-2014. The overwhelming majority of these were technical contacts between officers of the Office of the Head of the SKW responsible for international contacts with the official FSB liaison accredited at the Russian Embassy, ​​who provided correspondence, invitations, Christmas wishes, etc. They were of a nature similar to the visits of a middle-ranking Russian diplomat to the Polish Ministry of Foreign Affairs. They took place mainly in the Pass Office or the reception part of the SKW building. All those that had substantive value were recorded in the appropriate procedures,” we read in statement.

“Due to the false nature of the document, which in our opinion violates the vital security interests of the Republic of Poland, as well as personal rights, formal and legal possibilities of bringing the authors of the Report to both criminal and civil liability are currently being analyzed,” they added in conclusion.
