Elections are approaching in Poland. It is very important that they are fair and honest, said the EU Justice Commissioner Didier Reynders about the “lex Tusk” case in an interview with TVN24 correspondent Maciej Sokołowski. The deputy head of the European Commission, Vera Jourova, stressed that “the matter is urgent”. – When we analyzed the act, we saw that it may violate Article 2 of the Treaty on European Union, which is absolutely fundamental because it talks about democracy – she added.

European Commission sent a formal notification to Poland, thereby starting the infringement procedure on the so-called Lex Tusk Act.

As we read in the communiqué published on Thursday, the EC claims, among other things, that “the new law excessively interferes with the democratic process” and “by stating that a given person acted under Russian influence, the political rights of people elected in democratic elections can be limited.”

– I sent a letter to Poland saying that we are concerned about the new law. It is very difficult to agree with such a process that may deprive citizens of their rights, he added.

– I had to react immediately and asked the College of Commissioners to prepare an infringement procedure if needed. And indeed, a week later, the legal service started the infringement procedure, he said. – We will act quickly. We have already said that we will give the Polish side three weeks to respond to the reaction, because this case must go to court quickly – he announced.

The EU Justice Commissioner emphasized that “we have different instruments at our disposal”. “I don’t want to talk about everyone because we want to move quickly,” he said.

– I saw that there were already some reactions. The president said that he would propose amendments, submit the amendment to parliament, but the law has already entered into force. Therefore, it is very important that we have the determination to organize such activities that will protect a fair electoral process – he noted. – This is the first issue, the most important for democracy – he added.

Reynders pointed out that “there are also other things in the bill that are of concern.” – For example, the protection of personal data, this issue is also relevant. And we are concerned about the legality of various elements included in this law – he declared.

“I have said from the beginning that we are concerned about the lack of effective judicial review. Of course, there are possibilities of appealing to the administrative court, but there is no specific judicial review as to the content of the commission’s decision, he said. – We must protect democracy, this is one of the values ​​enshrined in Article 2 of the Treaty on European Union.
