Lex Tusk. What about the presidential amendment? Government spokesman: We do not have a clear position yet

There is still no clear position on whether we will support the president’s amendments, said government spokesman Piotr Mueller, referring to the “lex Tusk”, i.e. the act on the establishment of a commission for examining Russian influence. He added that he “does not exclude the possibility that the president’s project will be adopted.”

President Andrzej Duda Last Monday, he signed the act on the establishment of a commission for examining Russian influence on the internal security of the Republic of Poland in the years 2007-2022 and announced that he would refer it to the Constitutional Tribunal as a follow-up review. On Tuesday, the law was published in the Journal of Laws and entered into force on Wednesday. Its provisions were criticized by many law professors, lawyers and representatives of the opposition.

On Friday, four days after announcing his decision to sign the act, the president announced that he had prepared a draft amendment and that day it was submitted to the Sejm.

Government spokesman on the presidential amendment

Government spokesman Piotr Mueller, asked on Monday about the presidential project, said that “the president confirmed that this commission is still necessary.” – As for the amendments proposed by the president – at the moment there is no clear position whether we will support them or not – he added. – This project arrived on Friday, if I remember correctly. It will be reviewed and decisions will be made, I think early next week,” Mueller said.

When asked about nominating candidates for the committee, because a letter on this matter was sent to the clubs by the Marshal of the Sejm Elizabeth Witek, the spokesman emphasized that “the procedure begins in accordance with the current law”. He informed that no candidates for the commission had been submitted so far.

Mueller also said that he “does not exclude the possibility that the president’s project will be adopted.”

Changes in “lex Tusk” proposed by the president

The president announced the preparation of a draft amendment to the law on Friday. Andrzej Duda noted that his draft contained a provision that parliamentarians could not sit in the commission for examining Russian influence, and the countermeasures provided for in the current act were abolished (including a ban on performing functions related to the disposal of public funds for a period of up to 10 years), and the main subject of the commission’s finding will be the recognition that the person does not guarantee proper performance of activities in the public interest; moreover, an appeal against the commission’s decision is to be lodged with the Court of Appeal in Warsaw.
