License for the TVN Style channel. Appeal of KIKE, PIKE, KIGEiT to the National Broadcasting Council

“We appeal to the Chairman of the National Broadcasting Council and its Members to immediately take action to issue a decision on extending the license to broadcast the TVN Style program,” appeals the National Chamber of Commerce for Electronics and Telecommunications. In turn, the National Chamber of Ethernet Communications adds that “due to the topics covered in the content available in the TVN Style program and its popularity, the availability of this program is desired by subscribers and determines their attractiveness.”

National Broadcasting Council has still not decided to extend the license of the TVN Style channel, the largest women's television channel in the country, even though the appropriate application was submitted in July 2023. At the council meeting on May 22, 2024, the vote on granting a license for the next 10 years to TVN SA to broadcast the TVN Style program remained unresolved. The current TVN Style satellite license expires on July 28 this year.

On May 23, the Management Board of TVN SA issued a statement regarding the activities of the National Broadcasting Council. “Ownership structure of TVN Warner Bros. Discovery raises no doubts. This is confirmed by court judgments, numerous legal opinions and decisions of the National Broadcasting Council granting licenses to our group's channels,” the statement said. “The failure to extend the license for TVN Style and the statements of the head of the National Broadcasting Council are another unlawful attack on the American investor and the values ​​that unite our countries.” – added.

Due to the still unrenewed license, the National Chamber of Commerce for Electronics and Telecommunications (KIKEiT), the National Chamber of Ethernet Communications (KIKE) and the Polish Chamber of Electronic Communications (PIKE) sent letters to the National Broadcasting Council appealing for action to extend the license for TVN Style.

“We appeal to the members of the National Broadcasting Council to grant a license for the TVN Style program as soon as possible. Protracted re-license proceedings are not good for the Polish television market and destabilize the operator's business: introduces a large element of contractual uncertainty between the broadcaster of the TVN Style program and its distributors, but above all puts the audiovisual offer into question broadcaster for viewers – its customers,” argues the National Chamber of Commerce for Electronics and Telecommunications (KIGEiT).

Adding that television program distributors “want to offer a wide range of programs, among which the Polish television channel TVN Style with local products is very popular.” In the opinion of KIKE, these entrepreneurs will suffer measurable financial losses, “excluding from the offer a popular, recognizable TV program that has been on the market for many years may result in an outflow of customers.”

“As a Chamber associating telecommunications operators belonging to the group of small and medium-sized entrepreneurs, KIKE is concerned about media reports regarding the lack of extension of the license to distribute the TVN Style program,” we read in a letter from the National Chamber of Ethernet Communications (KIKE). Moreover, the Chamber informs that “telecommunications operators that provide television services cooperating with KIKE also express concern.”

“The failure of the constitutional body (National Broadcasting Council – ed.) to perform the tasks it was established to perform, directly affects the economic interests of telecommunications operators represented by the Chamber“- argues KIKE.

In the opinion of the Chamber, “the delay in conducting the proceedings for the extension of the license, the failure to issue a decision, despite the broadcaster's application submitted on time almost a year ago, entail the risk of a lawsuit on the part of the operators distributing this program significant ailments, especially financial ones” Adding that the failure to ensure the availability of the guaranteed program through no fault of theirs causes the risk of subscribers terminating their contracts, which may lead to a deterioration of their economic situation. In addition, they will have to notify customers in writing about the changed offer, as well as submit a notification to the register kept by the Chairman. National Broadcasting Council, which will result in them incurring additional costs.

KIKE explains that “The TVN Style program has an established position on the pay television program market. In the case of the vast majority of telecommunications operators associated in the Chamber, it is an element of the television offer addressed to subscribers. Due to the topics covered in the content available in the TVN Style program, and its popularity, the availability of this program in telecommunications operators' television service packages is desired by subscribers and determines their attractiveness.

“The lack of a decision by the National Broadcasting Council in the relicense proceedings is misleading a large element of contractual uncertainty between the broadcaster of the TVN Style program and its distributors, but above all calls into question our audiovisual offer to viewers” – the Polish Chamber of Electronic Communications (PIKE) writes to the National Broadcasting Council, asking about the schedule related to the extension of the license for the TVN Style program for the next period.

Arguing that “this is critical for the operator's business because the need to exclude from the offer a popular, recognizable television program that has been on the market for many years would involve significant operational, financial and image costs for the operators' environment.”

“We want to offer our clients a wide range of programs, including: The Polish television channel TVN Style with local productions is very popular” – summarizes PIKE.
