Police officers from Łomża detained a 57-year-old man who was wanted by the court to serve a sentence of one year and two months in prison. The man was sent to prison, but the Prison Service released him immediately. It turned out that the punishment ended on the same day. However, he did not enjoy his freedom for long. The matter turned out to be more complex.

It started just before Christmas, when a 57-year-old was walking through the streets of one of the villages of the Łomża district at night and listening to loud music.

“He also entered one of the properties, where he banged on the windows and kicked the front door of the house, and when no one opened the door, he damaged the side mirror of a car standing on the property. The next morning he returned and tried to damage the other car. He was stopped by the owner, who made threats to kill,” the police said in a statement.

He “threatened neighbors with death and burning down the house”

The man also threatened his wife, whom he was prohibited from approaching or contacting.

“On New Year's Eve, he went to his former neighbors, whom he also threatened to kill and burn down their house. A week later, he returned to their property, broke into the house, which he did not want to leave, and at the same time called names and threatened the residents, thus disturbing the peace in the house” – we read in the statement.

– The prosecutor supervising the case assessed that they would be sufficient. The man had, among other things, police supervision combined with a ban on contacting and approaching his wife – says Małgorzata Kosiorek-Soboń, head of the District Prosecutor's Office in Łomża.

They took him to prison and he was released immediately

On Wednesday, January 8, the police arrested the man again. This time it was about a court decision which – as the uniformed officers inform in a statement – stated that he was wanted to serve a sentence of one year and two months in prison for crimes against life and health and theft.

– We received the decision of the District Court in Łomża to search for him on the same day we detained the man. There have also been other interventions against him in recent weeks – the Asst. tells us. pcs. Karolina Wojciekian from the Municipal Police Headquarters in Łomża.

After the arrest, the police took him to prison. However, the Prison Service released him on the same day.

– SW officers told us that it was possible that this would happen, because the man had probably already served his sentence. We did not have such knowledge – notes Asp. pcs. Karolina Wojciekian.

Court: he has only two days left of his sentence

Judge Jan Leszczewski, spokesman for the District Court in Łomża, explains that 57-year-old Marek K., after being sentenced to one year and two months in prison, was initially in prison, but the court agreed that the man could finish serving his sentence in the system. electronic surveillance.

– However, the court overturned the decision in this case. It turned out that the man did not respect the law, abused alcohol and the police intervened against him. So an order was issued to take the man to prison, which the police did. However, the order stated that he had only two days left to serve. However, the Prison Service released him because – observing all procedures – it included in his sentence the time that had passed after his arrest and which he spent in police custody. Everything was done in accordance with the law, explains the judge.

Police: it didn't say there were only two days left

The previously quoted Asst. pcs. Karolina Wojciekian says that the court's decision did not say that the man had only two days left to serve.

The local portal mylomza.pl wrote that after the police learned that the man was at large, they warned the residents. What asp. Wojciekian confirms this to us, but – as he says – the uniformed officers only informed people who had previously (before Christmas and New Year's Eve) reported the man.

Another threat notification

Ultimately, the 57-year-old was caught by the police on the same day he was released from prison.

– He was arrested in the evening in one of the towns in the Śniadowo commune. Sam called the police, claiming that there had been an accident and that a man had been hit on the road. It turned out that such a situation did not occur at all. So it was a baseless report. In the meantime, we received a notification from a member of his family. It was about further criminal threats – explains Asp. pcs. Wojciekian.

He was finally arrested

The policewoman emphasizes that by the court's decision (at the request of the prosecutor's office), the man was temporarily arrested for three months.

– For making criminal threats and violating the privacy of the home, a man may face up to three years in prison, but due to the fact that he committed the crimes in conditions of recidivism, the penalty may be increased by up to half – sums up a representative of the police in Łomża.
