42-year-old Karol M., who fatally wounded a bailiff with a knife in a bailiff’s office in Łuków (Lubelskie Voivodeship), attacked an employee of the office and an intervening policeman, will be placed under closed psychiatric observation. – Experts on the basis of a one-time examination were unable to say whether the perpetrator was sane at the time of committing the act – the prosecutor’s office tells us.

– A forensic psychiatric examination was carried out. After the examination, the experts were unable to determine whether the perpetrator was sane at the time of committing the act, therefore they applied for psychiatric observation. The prosecutor applied to the court for a court-psychiatric observation and the court granted this request, informs Magdalena Naczas from the District Prosecutor’s Office in Lublin.

Karol M. will undergo a four-week, closed forensic and psychiatric observation. It can be extended if necessary. – Only after this observation, experts will issue a full opinion as to the sanity of the perpetrator at the time of committing the act – explains Naczas.

To brutal The attack on the bailiff took place on November 18, 2022 around 1 p.m. in the bailiff’s office at Kozia Street in Łuków. According to the police, a 42-year-old resident of the Wola Mysłowska commune attacked with a knife and wounded a bailiff and a law firm employee present there. The woman died in hospital the same day as a result of her injuries. The attacker was shot in the stomach by the intervening police officers and was taken to the hospital. On the evening of November 20, his condition allowed him to be interrogated. The 42-year-old pleaded guilty to five charges in total.

The first concerns the murder of a 44-year-old bailiff. According to the prosecutor’s office, the man, using a knife, struck the woman 40 times, causing, among other things, wounds to the head, chest and abdomen. Prosecutors concluded that the perpetrator acted as a result of “motivation deserving special condemnation”. For this act, the 42-year-old is facing a prison sentence of not less than 12 years to life imprisonment.

The second charge concerns attempted murder of a policeman who tried to apprehend the attacker and active assault on that officer. According to the investigators, the 42-year-old allegedly attacked the uniformed officer with a knife and tried to stab him in the head and chest.

The third charge concerns the attempted murder of a 32-year-old employee of a bailiff’s office. The man – as reported by the prosecutor’s office at the time – tried to defend the bailiff attacked by the attacker, then the aggressor lunged at him with a knife and hit him in the back of the head and hand. Also in this case, the prosecutor considered that the attacker acted with motives deserving special condemnation.

The fourth and fifth allegations concern the violation of the bodily integrity of a woman whom the 42-year-old allegedly attacked on his way to the office. According to the investigators, the man hit her on the right shoulder, spat on her and threatened to kill her.

42-year-old Karol M. did not admit to the charges against him. He made explanations, but the prosecutor’s office did not disclose their content.

The man was taken into custody by court order, where he remains to this day. The perpetrator’s motives are unknown. The prosecutor’s office said that the man was not a client of the bailiff’s office where he committed the attack, and before the assault he was in another office.

Protests in bailiffs’ offices across the country and an appeal to the minister

Three days after the tragedy in Łuków, bailiffs’ offices throughout Poland were closed as a sign of protest against what had happened. As the National Council of Bailiffs emphasized in a communiqué published after the event, “these actions are aimed at drawing attention to this tragedy and to the hate that we encounter in our work on a daily basis”.

After the tragedy in Łuków The Polish Bar Council appealed to the Minister of Justice Zbigniew Ziobro o “taking specific and immediate actions that will actually increase the legal protection of legal professionals, and will shape public opinion in an atmosphere of respect and understanding of their role in a democratic state ruled by law.”

A similar appeal to the head of the Ministry of Justice was also made by the National Council of Bailiffs, which “requested a firm reaction and immediate action to ensure the safety of bailiffs”.
