The question whether Kamiński and Wąsik had the right to demand admission to the Sejm was answered by Sylwia Gregorczyk-Abram on the initiative of Free Courts.

– Of course, they had no right, because their mandates expired when a final judgment was issued for a crime prosecuted by public indictment, sentencing them to imprisonment. The constitution here is clear, and so is the Electoral Code. These mandates expire at this time. This procedure before the Speaker of the Sejm, about which there is so much talk, does not concern the substantive verification of this decision, whether the mandates have expired rightly or wrongly, but concerns a kind of technical verification and approval of it by Supreme Court – said Sylwia Gregorczyk-Abram.

The second guest of “Fakty po Faktach” – vice-chairman of the State Tribunal, Jacek Dubois, commented on the entry on the X platform (formerly Twitter) of former MP Maciej Wąsik. Wąsik wrote yesterday that he is an MP and the Supreme Court confirmed it.

– The provision of Article 227 of the Penal Code states that anyone who impersonates a public official in order to perform his duties is subject to a penalty of up to one year. Therefore, we are talking about a crime and I am very surprised that the prosecutor’s office has not yet taken action. We had an attempt to impersonate a public official, so it was a prohibited act, says Dubois.

– Of course there is freedom in Poland, everyone can claim who they are. Mr. Wąsik can claim to be a crocodile or an MP as long as he doesn’t impersonate one. We have a compromising situation. I’m surprised why we’re talking about this and the prosecutor’s office isn’t intervening, he added.

“Of course there was no torture”

When asked if he knew whether Mariusz Kamiński was tortured, Dubois replied that “of course he does not.” He referred to the forced feeding of Kamiński. – Of course, there was no torture, it was all legal. When Mr. Kamiński refused to eat, he violated the law, because there are clear regulations that a convict cannot behave like that and the feeding procedure was completely legal. It was not the government’s action, it was an appeal to the court that issued the ruling and is entitled to do so, so it is a confusion of concepts and demagogy, Dubois explained.

– I followed the jurisprudence of the European Court of Human Rights after these words Jarosław Kaczyński. I agree with the attorney that there were grounds and appropriate preparation for this. It wasn’t the decision of the prison guard or the prison director. There were medical opinions that simply indicated that if Mr. Kamiński was not fed through a tube, he might die or his health would be significantly damaged, said Gregorczyk-Abram.

– If we weigh two values: life and health or interference with his freedom and personal integrity, it is clear that life and health must win. Hence this decision, approved by the penitentiary court, which allowed this type of procedure, she added.

What were Wąsik and Kamiński convicted of? “They started to test citizens for justice”

When asked what the charges against Kamiński and Wąsik were about, Dubois replied that they were primarily about exceeding their powers. – It was an abuse of powers, first of all, because they undertook illegal surveillance and began to test citizens for justice, which cannot be done. You can initiate a provocation when there are grounds for it. They did it without any reasons – said the guest of “Fakty po Faktach”.

– Then there was obtaining court consents for wiretapping, and then there was the introduction of illegal documents into public circulation. This list of allegations was very long. It was a consistent action where the officers exceeded their powers, so we are not talking about politics, we are talking about criminal matters and that is what they were convicted of, he added.

What was the land scandal?

The land scandal was a provocation against the then deputy prime minister in Jarosław Kaczyński’s government – Andrzej Lepper. However, the leak made it difficult to bring the matter to an end. According to the court, Kamiński planned and organized the CBA provocation, ordered one person to be misled and incite corruption, while there were no grounds to initiate a CBA operation in the Ministry of Agriculture. Kamiński’s orders were carried out by his deputy Maciej Wąsik and two officers from the operational and investigative department – we read on Konkret24.

As a result, Andrzej Lepper was dismissed by the then Prime Minister Jarosław Kaczyński, thus the PiS-Samoobrona-LPR coalition collapsed, which resulted in premature elections. After them, the PO-PSL coalition took power.
