More and more controlled entities unlawfully and with impunity question the powers of the Supreme Audit Office, said the President of the Supreme Audit Office, Marian Banaś, in the Senate. He reported that “the most glaring examples of hindering the operation of the NIK” occurred, among others, during an audit attempt in Orlen. – In recent years, we have submitted nearly 200 notifications of suspected crimes, and the prosecutor’s office initiated only a few proceedings on their basis – he noted.

President of the Supreme Audit Office Marian Banas informed the Senate on Wednesday about the obstacles in the performance of constitutional duties in the implementation of state control in Poland, together with information on the inspections carried out.

As he said, Article 202(1) of the Constitution provides that “Supreme Chamber of Control is the supreme body of state control.

– NIK has not only the right, but also the obligation to carry out state audits. Control, which is to protect public funds against waste. Unfortunately, the process of limiting the NIK’s powers to control, acquire and spend public funds is intensifying, Banaś said.

As he informed, “more and more controlled entities unlawfully, but also with impunity, question the powers of the Supreme Audit Office”. – This practice applies not only to foundations established by companies with State Treasury shareholding and their daughter companies, but also to companies with majority shareholding of the State Treasury. So far, the most glaring examples of hindering the operation of NIK have occurred, among others, as part of audits concerning the implementation of measures to improve fuel safety in the oil sector and selected expenses of companies with State Treasury shareholding and foundations created by these companies – he said.

Banaś: the president and members of the management board of Orlen prevented the activities

As the head of the Chamber said, in the first of the inspections mentioned, “both the president of the management board and members of the management board of PKN Orlen, acting through the appointed proxies of the company, prevented the performance of official activities by the NIK auditors, causing the company to be ultimately not covered by the audit in question” . – Moreover, the District Prosecutor’s Office in Warsaw refused to initiate an investigation in this case – he stressed.

– On the other hand, in the second control, concerning selected expenses of companies with State Treasury shareholding and foundations created by these companies, a total of as many as 10 notifications about the possibility of committing a crime were submitted. Only with regard to the notification concerning the members of the management board of Energa SA, an investigation was initiated by the prosecutor’s decision. After a few months, it was unfortunately discontinued, he pointed out.

– In recent years, we have submitted nearly 200 notifications of suspected crimes, and the prosecutor initiated only a few proceedings based on them – continued Banaś. – As you can correctly guess, the indictments have not yet been submitted to the competent courts – he added, addressing those gathered in the Senate.

Head of NIK: Unfortunately, cooperation with the Marshal of the Sejm is not going well

He reminded that, in accordance with the constitution, the NIK is subordinate to the Sejm. – I have to admit that cooperation with the majority of the Sejm, especially the Marshal of the Sejm, is unfortunately bad. My applications regarding the appointment of the director general of NIK have not been considered. Moreover, from August 2019 to the present day, I have submitted as many as 40 applications to the Marshal of the Sejm for the appointment of new members of the college. Today, there are only seven people in it, including me, and there are to be as many as 19 of them. It should be remembered that this violates Article 202(3) of the Constitution

The Supreme Audit Office operates on the principles of collegiality.

As Banaś emphasized, “I have asked the Marshal of the Sejm many times to help the Supreme Audit Office, but we have not received such support.”
