The Minister of Justice, Zbigniew Ziobro, has been doing what he has been doing for eight years – he uses the law for politics, for pure party interests, said Ryszard Kalisz, a lawyer and former head of the Ministry of the Interior and Administration, referring to Ziobro’s decision on the basis of which the convicted robbery 24 -year-old Marika was released. – This shows exactly how dangerous it is to combine a political minister of justice with a theoretically apolitical prosecutor general – said prosecutor Katarzyna Szeska from the Lex Super Omnia association.

Marika, 24, was sentenced to three years in prison. She did a year. In mid-July, a Catholic, far-right organization Ordo Iuris launched a social campaign to convince the president Andrzej Duda to pardon the 24-year-old. “Together with three other people, in a gesture of opposition to the promotion of far-left ideologies, she tried to snatch a bag in the colors of the movement from a woman LGBT. She was subsequently charged,” wrote Ordo Iuris.

By decision of the Minister of Justice and the Prosecutor General Zbigniew Ziobro convicted 24-year-old Marika was released. The law allows for a break in punishment during the course of the pardon proceedings.

Journalists from “Gazeta Wyborcza” reached the verdict, which shows that the convicted 24-year-old, together with another convict, used “violence in the form of pulling, pushing and twisting the third finger of the left hand.” “As a result of the struggle, the assaulted woman suffered injuries such as bruises on her hand and a sprain of the distal phalangeal joint of her left hand” – it was described.

The case was commented on by a lawyer and a former interior minister in “Tak jest”. Richard Kalisz and prosecutor Katarzyna Szeska from the Lex Super Omnia association.

Kalisz: Ziobro uses the law for politics

In the opinion of Ryszard Kalisz, Minister Ziobro’s knowledge of the law “is not very high”. – I do not know whether Minister Ziobro has ever admitted in the last few days that he tightened the provisions of the Penal Code as part of penal populism, limiting the freedom of imposing punishment by judges – he said.

– Minister Ziobro is getting into all this, embarrassing himself more and more – he said. He added that Ziobro “does what he has been doing for eight years – he uses the law for politics, for pure party interest.”

Kalisz drew attention to the “facts” of the case. – They came from Gniezno to Poznań specially to beat people and commit robberies. This victimized girl did not participate in the Equality Parade at that moment. She was leaving the store, there was one, and there were four of them – he noted.

Szeska: the prosecutor correctly directed the indictment

– There was a robbery. The prosecutor correctly filed the indictment. There is a very detailed description of the act. (…) The violence was aimed at the victim, not at the handbag. At that point, it was an attempted robbery. They did not manage to get the bag out, but only because of the victim’s attitude, explained prosecutor Katarzyna Szeska.

She added that “there was violence, there was a desire to take property.” – It does not matter what value this property is and it does not matter whether this violence is very drastic or less drastic, but it was because it was pulled, it was pulled by the hand – she emphasized.

In her opinion, Ziobro’s conferences prove that he “forgot that he is the Minister of Justice”. “This shows exactly how dangerous it is to combine a political minister of justice with a theoretically apolitical prosecutor general,” she added.

“I have very serious concerns about the professional safety of the prosecutor who filed the indictment in this case,” she said.
