Former PiS government ministers Mariusz Kamiński and Maciej Wąsik, sentenced to two years in prison in connection with the “land scandal”, did not accept the documents regarding the expiry of their mandates during the meeting of the Parliamentary Committee on Administration and Internal Affairs. In the TVN24 program “You get up and know”, lawyer prof. Maciej Gutowski was asked whether the delivery was effective, as the head of this commission, Maria Janyska, claimed.
– If the addressee has the opportunity to read the content of the letter and does not accept it of his own free will, then (in my opinion) delivery has taken place – said the TVN24 guest.
Prof. Maciej Gutowski reminded that Mariusz Kamiński and Maciej Wąsik have three days to appeal to the Supreme Court against the decision of the Speaker of the Sejm Szymon Hołownia regarding the expiry of their mandates. – To the Chamber of Extraordinary Control and Public Affairs, another contaminated body in our judiciary. And then the issue of the appeal procedure will be clarified – said Gutowski.
According to the lawyer, the decision on the expiry (of mandates) is a declaration of something that happened by operation of law. – A final judgment eliminates the ability to be an MP – said Gutowski.
The TVN24 interlocutor, asked whether Kamiński and Wąsik were MPs, replied. – In my opinion, they are not MPs.
