Convicted PiS politicians Mariusz Kamiński and Maciej Wąsik may be sent to prison at any time. The documentation regarding the arrest is ready, and when it reaches the police, action will be taken “immediately”. At the same time, there is an ongoing dispute over the expired parliamentary mandates of Kamiński and Wąsik. On Tuesday, they are to meet the president, who invited them to a ceremony at the palace. We remind you what happened on Monday.

Mariusz Kamiński and Maciej Wąsik were sentenced in December 2023 by a final judgment to prison in the so-called land scandal. In her justification for the judgment, the judge pointed out that their actions not only did not aim to detect crimes, but also “created this crime.”

Kamiński and Wąsik do not recognize this court ruling and argue that they were pardoned by President Andrzej Duda in 2015 and that their parliamentary mandates have not expired. The president claims the same – his aides have repeatedly said that he is not considering granting a second pardon.

What happened on Monday afternoon

On Monday, around 4:30 p.m., the Warsaw district court announced that “executive documentation was prepared, including delivery orders convicted MK and MW to penitentiary units. This means that Kamiński and Wąsik may be detained and sent to prison at any time.

After 6 p.m., the police announced that no court decision in this case had been received yet. “After receiving the relevant documents, the Police will carry out administrative activities provided for by law,” the statement added.

Head of the Ministry of Interior and Administration Marcin Kierwiński assured that when the services receive the decisions, “appropriate action will be taken immediately“.

In the evening on Trwam TV, Maciej Wąsik was asked what he would do if the police wanted to detain him. – They will have to use some coercion and they will probably succeed. I won’t fight with policemen. They are not guilty of anything, he said.

The head of the president’s office, Marcin Mastalerek, announced on social media that President Andrzej Duda invited MPs Mariusz Kamiński and Maciej Wąsik to the Presidential Palace on Tuesday at 11 a.m. There will be a ceremony of appointing their close associates Błażej Poboży and Stanisław Żaryn as advisors to the president.

Dispute over expired mandates

At the same time, there is also a dispute regarding the parliamentary mandates of Kamiński and Wąsik. After the final judgment, the mandates expired and the Speaker of the Sejm Szymon Hołownia issued decisions on this matter.

Kamiński and Wąsik appealed to the Supreme Court, and its Chamber of Extraordinary Control and Public Affairs overturned the Marshal’s decisions. However, this Chamber is not recognized as a court under European law, a Court of Justice of the European Union stated that it is not an “independent and impartial court”. Meanwhile, the Chamber of Labor and Social Insurance of the Supreme Court, to which the Speaker of the Sejm sent the appeals of PiS politicians, is to decide on January 10 as to the validity of the Marshal’s decisions stating the expiry of their mandates.

On Monday, the first president of the Supreme Court, Małgorzata Manowska, issued a statement in which: criticized the president of the Chamber of Labor, Piotr Prusinowskiwho in her opinion “disregards the order of the first president”, committed “arbitrary” and concluded an “agreement” with the Speaker of the Sejm.

The president maintains that his 2015 pardon is valid and that MPs should keep their mandates. On Monday, he invited the Speaker of the Sejm to a meeting. He suggested to him – as he later said – “that in order to close this case and avoid unrest (…) we should simply acknowledge today that the pardon from 2015 was and is effective.” Hołownia did not accept the proposal.

On Monday, the Marshal conducted a series of consultations – talked to the Minister of Justice Adam Bodnar, the Commissioner for Human Rights Marcin Wiącek and legal authorities.

According to information from “Gazeta Wyborcza”, on Monday around 5 p.m., after the court’s announcement regarding the arrest of Kamiński and Wąsik, the president met with the first president of the Supreme Court. “Witnesses saw the presidential motorcade approaching Prof. Manowska’s house, then the SOP cars withdrew to a nearby bus depot. After more than an hour, they returned and joined Duda’s leaving car,” the newspaper wrote.

The next session of the Sejm will start on Wednesday. Kamiński and Wąsik agreed that they intended to appear there. However, their parliamentary cards are deactivated.

Kamiński and Wąsik. What were they convicted of?

In 2007, the CBA, headed by Mariusz Kamiński (Maciej Wąsik was his deputy), organized a provocation that was intended to attack the then Minister of Agriculture, Andrzej Lepper. The agents of the Bureau were to offer officials a bribe of several million zlotys for the de-agriculture of a plot of land in Masuria. Due to the leak, no money was transferred and the CBA operation ended in failure. As a result, Lepper was dismissed by Jarosław Kaczyński (he was prime minister at that time). The political earthquake led to the collapse of the PiS-Samoobrona-LPR coalition and to premature electionsas a result of which the PO-PSL coalition took power.

Judge Anna Bator-Ciesielska, who announced the final judgment in the case of Kamiński and Wąsik in December 2023, said that their actions years ago, when they headed the CBA, “were far from” the standard of operation of law enforcement agencies within the framework of operational control and provocation. – The activities undertaken by the defendants described in the judgment were not only illegal (…) They were not activities aimed at detecting crimes, but rather creating the crime – said the judge.
