Mariusz Kamiński and Maciej Wąsik were pardoned. Adam Bodnar: I made sure that the documents were handed over

The document regarding the pardon of Mariusz Kamiński and Maciej Wąsik, signed by Andrzej Duda, was delivered to the National Prosecutor’s Office around 6:40 p.m. – said the Minister of Justice, Adam Bodnar. He added that the law of pardon included pardoning prison sentences and a ban on holding public positions.

President Andrzej Duda announced on Tuesday the issuance of a decision to apply the law of clemency to… Mariusz Kamiński and Maciej Wąsik.

Bodnar was asked on TVP Info whether there is a new document, dated today, that proves that Kamiński and Wąsik are free, he replied: – Yes, right after the press conference (of the president – ed.) took place, I went specially to the National Prosecutor’s Office to see whether this document has actually been received. We found out that the Department of Pardons is working all the time, there is a special department in the National Prosecutor’s Office, this document around 6.40 p.m. received at the National Prosecutor’s Office. This is actually today’s decision, which refers to the situation of Mr. Wąsik and Mr. Kamiński – said the head of the ministry.

– I made sure that these documents were handed over. I saw the director of the Judicial Proceedings Department at the National Prosecutor’s Office. He is in contact with the District Court for Warsaw-Śródmieście and in fact the decision now belongs to the penitentiary court, so this order to leave the premises, one could say, is beyond me, said the Minister of Justice.

Bodnar about the president’s decision

He added that what is “most important in this decision is the reference to all judgments that have been issued in the case, including the judgment of December 20, 2023.” – And secondly, the president will forgive the punitive measures that have been imposed against these two gentlemen – said Bodnar.

When asked whether the loss of a parliamentary mandate is also a punitive measure, he said: – It is formulated there in such a way that the right of pardon consists in remission of the penalty of two years of imprisonment and punitive measures in the form of a ban on holding public positions.

When asked whether Kamiński and Wąsik effectively had parliamentary mandates again, he replied: – I think not, because it is a completely different situation. These seats were irretrievably lost and this was confirmed by the Speaker of the Sejm, Szymon Hołownia. However, in accordance with this decision, in my opinion, absolutely, if they wanted to run for office in elections local government or in elections to the European Parliament, there are no obstacles to this.

When asked why he did not accept the president’s request and recommend a pardon, he replied that he “believes that what these gentlemen did is a serious official crime that was properly assessed by both the court of the first and second instance.” – For such official crimes, the punishment imposed is adequate – he added.

On December 20, 2023, the District Court in Warsaw sentenced Kamiński and Wąsik to two years of imprisonment. On January 9, the police detained Kamiński and Wąsik, and later they were imprisoned.
