The application submitted to the Sejm by the prosecutor's office concerns envelope elections. Adrian Witczak from KO expressed hope that the former prime minister “will not follow in the footsteps of Marcin Romanowski and run away anywhere.” Morawiecki was defended by his party colleague, PiS MP PrzemysĊ‚aw Czarnek, who stated that the former prime minister “performed his constitutional duties.”

The prosecutor's office submitted a request to the Sejm in this case lifting the immunity of Mateusz Morawiecki in connection with the case of the 2020 envelope elections, which did not take place.

The information was confirmed by the Speaker of the Sejm at an afternoon conference Szymon HoĊ‚ownia. – Today before noon I received a request to waive the immunity of (…) the MP Mateusz Morawieckibased largely – as I reviewed it – on the findings of the Sejm investigative committee – he said. – I am glad that the prosecutor's office is taking advantage of this work in the parliamentary investigative committee – he added.

HoĊ‚ownia on next steps regarding the application

As HoĊ‚ownia said, “it is, of course, about organizing envelope elections, about Mateusz Morawiecki's responsibility for organizing these elections when he was prime minister.” – These irregularities and costs listed in this application (…) exceed PLN 50 million – he noted.

He also informed that “the fate of this application is the same as all immunity applications.” – Today I referred it to the legal services of the Sejm for formal control and obliged them to present their opinion on this matter to me on Monday. I hope that on Monday I will be able to refer this request to the Rules, Deputies' and Immunities Committee, he said.

– Although it also seems unlikely to me – because there is a whole queue of applications waiting to be considered – that this application could be processed and considered already at this session of the Sejm – he reserved.

Witczak: I hope Morawiecki will not run away anywhere

The matter was also commented on by Adrian Witczak, MP of the Civic Coalition, in an interview with TVN24 in the Sejm. – The prosecutor's office collected evidence. On this basis, a motion was submitted to the Speaker of the Sejm, who will refer the motion to the Rules Committee. A parliamentary majority is needed to lift Mr. Morawiecki's immunity – he explained.

– I hope that Mr. Morawiecki will not follow in the footsteps of Mr. (Marcin) Romanowski and will not run away anywhere, but will stand before the prosecutor's office and explain clearly – he said. He assessed the collected material as “disturbing”. – Because everything indicates that the envelope elections were to be held illegally and the money spent from the state budget was spent unjustifiably – he added.

KO senator Krzysztof Kwiatkowski, commenting on the prosecutor's opinion, said: – As the classic says, it was obvious.

– When in 2020, Mateusz Morawiecki, as Prime Minister, ordered Poczta Polska to organize illegal elections, because it is the responsibility of organizing elections in Poland National Electoral Commissionand not the Polish Post Office or a beauty salon on any street, what happened was to be expected – he said.

– The Provincial Administrative Court found that Mateusz Morawiecki had broken the law in June last year Supreme Administrative Court dismissed the cassation appeal in this case. From that moment on, the case was formally ended and we could only wait for what had to happen, i.e. a request to waive Mateusz Morawiecki's immunity so that he would be held responsible for breaking the law – he added.

– We do not forget about these matters. Maybe some people expected it to be faster – said Ryszard Petru, MP from Poland 2050.

– There is a chance that Mateusz Morawiecki will be brought to justice this year, but it will be the court's decision and the court must be given the opportunity to make this decision. Therefore, I cannot imagine that this immunity would not be waived in such an important case, he said.

Motyka: we will support this motion

Deputy Minister of Climate, press spokesman PSL MiĊ‚osz Motyka announced that the People's Party members would vote to waive immunity. – If someone exceeds his/her authority, any official at any level is held accountable. And here we have a situation in which Prime Minister Morawiecki issues a decision and resolution without a legal basis, exceeds his powers, interferes with competences that are not his, so we absolutely need a request to waive his immunity and bring specific charges in this matter – he said.

He argued that “there is no way for public authorities to act without the basis of legal provisions and go beyond these frameworks, so we will absolutely support this motion.”

PiS MP PrzemysĊ‚aw Czarnek commented that “in November 2023, the District Court in Warsaw (…) upheld the discontinuation of the prosecutor's proceedings (…) in the case of both Prime Minister Mateusz Morawiecki and Prime Minister Jacek Sasin.” – And the case concerned exactly the same thing, i.e. the organization of elections on May 10, 2020 – he pointed out.

According to the PiS MP, the court found that “both gentlemen, including Prime Minister Morawiecki, performed their constitutional duties.”

As he said, “today, the prosecutor's office, extremely politicized and illegally managed by the usurper in the position of national prosecutor, is re-initiating proceedings.”

– When it is expensive, when everything is falling apart, when Poland has no allies in its economic life, it is thrown out of the way, you could say, by United Statesbecause Poland is ruled by people like (RadosĊ‚aw) Sikorskiwho offend presidents of the United Statesthen they really have nothing else to do but re-initiate proceedings that have already been discontinued, also by the court – he said.

This is – as Czarnek said – “shame and disgrace”. – I would like to remind you that there are also provisions of the Penal Code that indicate that if someone knows that a crime has not been committed and yet notifies the prosecutor's office and the proceedings are continued by the illegal prosecutor's office, he will be subject to criminal liability – added the PiS MP.
