Mateusz Morawiecki talks again about the migration packet. And manipulates again

The migration pact has been in force since the time of Tusk, the current prime minister agreed to the pact, and earlier it was “Morawiecki's Kotwica” blocked the pact – such theses were presented by PiS politicians at a press conference. Although they were overthrown several times, the opposition continues to play them in the presidential campaign, which is why we present the facts again.

At a conference organized by Law and Justice on May 21, 2025 in the Sejm, former Prime Minister Mateusz Morawiecki and former European Affairs Minister Szymon Szynkowski vel SÄ™k. They talked about one of the hottest topics of the ongoing election campaign, i.e. migration packet. In their long translations, they tried to prove that the current government of Donald Tusk is responsible for signing and implementing the pact. In addition, they claimed that the migration pact has been in fact since 2014 or 2015, i.e. since the previous government of the PO -PSL coalition, in which – most importantly in their narrative – the minister was the candidate for president RafaÅ‚ Trzaskowski. Mateusz Morawiecki, therefore, tried to convince that the only chance to reject the migration pact was to choose President Karol Nawrocki, who in his campaign repeatedly promised that “a migration pact” unilaterally.

As PiS politicians and the Confederation threatened the migration pact throughout the entire election campaign, Morawiecki and Szynkowski vel Sęk did not reveal new facts, but repeated or extended many false theses proclaimed for months. So we explain at what four main points regarding the migration pact PiS MPs were wrong.

1. Documents from 2014-2014 are not a migration pact

Mateusz Morawiecki, speaking of the current migration packet, unexpectedly referred to documents from 10 years ago, when he said: “Migration pact – Déjà VU – had already been since the time of Prime Minister Tusk and Prime Minister Kopacz. 2014, 2015. 10 years ago. And in 2016, my predecessor, Mrs. Prime Minister Beata SzydÅ‚o blocked. Adding this topic to the discussion was most likely the goal of the conference, because after the Morawiecki thesis about the migration packet from the time of the PO -PSL rule, Szymon Szynkowski vel SÄ™k repeated, saying: “The history of the migration pact actually begins 10 years ago. It was then the government of Ewa Kopacz and the minister responsible for European matters, secretary of state in this government – RafaÅ‚ Trzaskowski undertakes. In the summer of 2015, which end with the consent of Ewa Kopacz's government with the present in this government and the responsible – I emphasize once again – for these matters RafaÅ‚ Trzaskowski, consent to the relocation mechanism introduced for the first time. “

Talking about a migration packet 10 years ago is confusing concepts and misleading. EU migration pact (migration and asylum pact) A set of regulations and directives proposed by the European Commission only in September 2020. It was then that negotiations on the pact began, whose most important ordinances the Council of the European Union adopted in May 2024 (with opposition to, among others, Poland).

The solutions that PiS politicians talked about at the conference were not a set of ordinances, but a temporary way to deal with the migration crisis, with which the European Union struggled in 2014-2015. We would like to remind you that tens of thousands of refugees and migrants came to the south of Europe, especially to Greek and Italian islands, and local services were not able to accept their applications for international protection. Therefore, other EU countries discussed how to solve this crisis and help countries under migration pressure. In September 2015, the relocation mechanism was introduced, but only on a voluntary basis. Ultimately, however, no refugees went to Poland as part of this mechanism, and the directive itself expired in September 2017. It is not true, therefore, that it is “the migration pact in force since the time of Prime Minister Tusk and Prime Minister Kopacz, because that document was only to temporarily solve problems with the influx of migrants to the south of Europe. The migration pact negotiated since 2020 is to comprehensively reform the EU migration policy and give the European Union tools to deal with similar crises in the future.

2. The Morawiecki government did not blur the pact

Continuing the history of the alleged “migration pact” from 2014-2015, Mateusz Morawiecki recalled: “Then I at the European Council, in June 2018, which can be very easy to check, I led to de facto blocking the migration pact and until the end of our government, until December 2023, the migration pact did not apply. Despite what Trzaskowski did for illegal. immigrants, we blocked a migration pact. ”

Szymon Szynkowski vel SÄ™k called this action of the former head of the government “Morawiecki Kotwica”. “Construction of the Coalition of States in Brussels in this matter completed by entering the conclusion in June 2018 that the relocation mechanism can only be used on a voluntary basis, i.e. the so -called Morawiecki anchor” – said the former Minister of European Affairs. “[Kotwica] Proposed by Prime Minister Mateusz Morawiecki then to the conclusion, adopted unanimously by all countries. And this is the main anchor, which for the coming years that there is no return to the subject of relocation of migrants and a migration pact, “he added.

Indeed, in the conclusions of the European Council summit in June 2018, in which Mateusz Morawiecki took part, a point on the distribution of migrants was concluded in closed centers for foreigners in various Member States, and at its end added: “all means in the context of these centers, including relocation and displacement, will be voluntary.” However, the claim that due to this record a migration pact was not in force until the end of 2023 is unfounded. As we wrote earlier, the concept of the pact appeared only in September 2020, two years after the adoption of the above -mentioned conclusions. In addition, the conclusions are only an expression of political will and a direction of activities, but it is only regulations and directives that create EU law in PAKT.

Mateusz Morawiecki additionally believes that he was blocked by the migration pact until December 2023, when he ceased to be the prime minister. During his premiere, however, the work on the pact lasted continuously according to the schedule, and the European Parliament and the EU Council reached preliminary agreements regarding most acts included in the Pact. After Morawiecki's departure from the office, on December 20, 2023, the parliament and council reached a key political agreement that opened the process of approving the migration pact. This date, however, has nothing to do with the change of government in Poland, and only resulted from the end of negotiations between the negotiators from the parliament and council.

3. Tusk's government did not accept the Pact

Another false thesis from the conference of Mateusz Morawiecki and Szymon Szynkowski Vel SÄ™ka is associated with reaching a key agreement between parliament and advice. They claimed that immediately after taking power in Poland, the government of Donald Tusk “accepted” or “signed” a migration pact. The former prime minister said: “It took only a week to the current prime minister, my successor, to de facto agree, de facto – I emphasize, agree to the migration pact in December 2023. A simple matter. A simple story. They agreed to the migration pact.” The former European Affairs Minister repeated: “Finally, December two thousand of the twenty -third year, a week after the change of government, and then this is the first, preliminary agreement on the migration pact at European level, which also agrees to Donald Tusk. The final decision on the migration pact is made in May 2024, when these documents, this set of regulations is adopted.”

However, as we have already explained, the Polish government had no influence on the agreement between parliament and council negotiators. Any claims that at that time Donald Tusk agreed to any solutions of the Pact are untrue. At that time, all Pact documents had their previously established shape negotiated in previous years. It is also worth noting that the agreement between parliament and council did not yet mean “acceptance of the pact”, because such suggestions also fell in the past from PiS deputies.

The migration pact formally adopted in May 2024 the Member States' ministers of the European Union Council. The Minister of Finance, representing the Polish government, Andrzej DomaÅ„ski voted against all ordinances consisting of a pact, but the qualified majority of countries were “for”. It is not only that it is not only that the government of Donald Tusk agreed to the migration pact in December 2023, but that he was “behind” this solution at all.

During the election campaign, PiS and confederation politicians tried to convince that the current government de facto is already implementing a migration pact because it accepts migrants “shifted” from Germany. Szymon Szynkowski vel SÄ™k at the conference said that the Germans “by means of the so -called entry refusal to send Poland … Over 10,000 illegal immigrants have already been estimated from the beginning of 2024.” However, these procedures have nothing to do with the migration pact, because they are based on regulations adopted many years ago regarding refusal to enter Germany or to transfer migrants who had previously submitted asylum application here.

4. The president cannot terminate the Pact

Finally, let us remind you that the former prime minister assured that “the president of the state with a strong social mandate may block the migration pact.” The PiS candidate Karol Nawrocki himself announces that after taking the office “a migration pact”. Experts in European Union law, which we talked to in this matter, but they cool such impulses and ensure that under EU law, the statement of the Pact is simply impossible.

“You cannot unilaterally terminate the migration pact because it includes acts of the so -called secondary law of the European Union, to which Poland authorized EU institutions in treaties” – said prof. Izabela Skomerska from the University of Lodz. “There is no unilateral procedure for 'termination' of such acts. Of course, it is possible to change the regulation/directive, but together by the EU Council and the European Parliament. The unilateral action of the Member State has no effectiveness” – added prof. Anna Doliwa-Klepacka from the University of Bialystok.

Experts also emphasized that the President of the Republic of Poland does not participate in the legislative process in the European Union, so any termination of legal acts, even if it was possible, would not be in his competence.
