Medyka, Przemyśl. The mayor fired the clerk, he heard allegations. A woman in front of an orchard fights to return to work

Proceedings have started before the Labor Court in Przemyśl (Podkarpackie Voivodeship), which one of the employees of the Commune Office in Medyka brought against the mayor, Marek I. The woman believes that she was unlawfully dismissed from work and is fighting for her reinstatement.

The woman has been employed at the Commune Office in Medyka since November 2016. She was fired from her job on February 1, 2023 after returning to work with sick leavewhere she has been since December 2022. The reason for her dismissal was to be the “loss of trust” of the mayor to the subordinate.

The woman is of the opinion that she was unjustly dismissed and is fighting to get her back to work.

The clerk reported the irregularities to the chairman of the commune council

The relationship between the clerk and the mayor was to break down when the woman decided to end their relationship. It was then – as she claims – the mayor’s behavior towards her was to change. The woman informed the chairman of the Commune Council in Medyka about the improper behavior of her superior, who – after considering the matter with the commune council – submitted a notification to the District Prosecutor’s Office in Przemyśl.

The commune council also informed the National Labor Inspectorate and the Podkarpackie Voivode, Ewa Leniart, about the case.

Prosecutor’s proceedings ended on 17 April this year with the indictment to the Przemyśl district court. The prosecutor’s office accused Marek I. of crimes under Article 207 paragraph 1 of the Penal Code in connection with Art. 207 pairs 3 of the Penal Code and Art. 218 pairs 1a.

Paragraph 1 of Article 207 speaks of abuse of a person “remaining in a permanent or temporary relationship of dependence on the perpetrator”, paragraph 3 of “taking one’s own life” as a consequence of abuse.

According to the findings of the investigators, the head of the commune of Medyka, Marek I., from February 2021 to November 3, 2022, abused his subordinate official, including harass her with phone calls and text messages at various times of the day and night, intrude in her apartment and other places, call her names, humiliate her, slander, mock her, slander her and threaten to dismiss her.

– He repeatedly violated bodily integrity at the workplace against the victim’s will, threw documents at her, made offensive gestures, interfered with the performance of her duties, as a result of which the victim took her own life on September 29, 2021 – said Marta Pętkowska at tvn24.pl, press officer of the District Prosecutor’s Office in Przemyśl.

Prosecutor’s office: unreasonably delayed payments, admonished, finally dismissed from work

The second allegation concerns the violation of employee rights and, as determined by the investigators, it was to take place in the period from February 2021 to February 2023. – As the head of the commune of Medyka, while performing activities in matters in the field of labor law and social security, he maliciously violated employee rights by issuing instructions that contained and violated human dignity in its form, threatened to refuse previously granted leave, unreasonably delayed the payment of remuneration, gave unjustified admonitions and unjustifiably terminated the employment contract “due to loss of trust” – prosecutor Pętkowska told us.

According to the prosecutor’s office, the mayor had an informal relationship with the official. The irregularities began to occur when the woman decided to end it.

On Tuesday (June 6), the trial of Marek I was supposed to start before the District Court in Przemyśl. But it did not start because the defendant’s defender applied for the exclusion of the judge from the case. As judge Małgorzata Reizer, spokeswoman for the District Court in Przemyśl, told us at that time, the reason was the fact that the judge did not agree to exclude the transparency of the trial, as requested by the defendant’s defender.

The mayor pleaded not guilty to the charges and faces up to 12 years in prison

Marek I. – as reported by the prosecutor’s office – did not admit to the charges against him. – He made extensive explanations that were not confirmed by the evidence – Pętkowska tells us.

We wanted to ask Marek I. for a comment on the case, but when he heard a question about the process, he disconnected the call, he did not answer the next one.

Marek I. is facing from two to 12 years in prison for his actions.
