Minister of Justice Adam Bodnar delegated judge Anna Kalbarczyk to the Warsaw-Praga District Court. Kalbarczyk wrote a letter to the minister asking to withdraw her nomination to the District Court and conduct another possible nomination procedure to the Court of Appeal. She was nominated for the SA seat in 2019 by the politicized neo-National Council of the Judiciary.

Minister of Justice Adam Bodnar on Friday signed the delegation of judge Anna Kalbarczyk to the Warsaw-Praga District Court for an indefinite period – it was reported Ministry of Justice in the message. “Minister of Justice Adam Bodnar positively assessed judge Anna Kalbarczyk’s decision to take part in a legal competition and her declaration of the need to implement the jurisprudence of international tribunals. In his opinion, judges must take into account applicable international law in their judicial work. This is a necessary condition for maintaining the impartiality and independence of courts,” the Ministry of Justice announced.

Anna Kalbarczyk describes her story in a letter to Adam Bondar, published in its entirety by the OKO.press portal. He has been a judge for over 25 years. “As a judge, I was faced with many professional choices at that time. And I always took responsibility for them, which I still do now,” she wrote.

Kalbarczyk asked to “consider the possibility of delegating her to the Warsaw-Praga District Court”, where she worked before her nomination to the SA in Warsaw.

The amendment to the Act on the National Council of the Judiciary of December 2017 introduced, among others, the principle that 15 judicial members of the National Council of the Judiciary are elected by the Sejm – previously they were elected by the judicial community. Since then, the National Council of the Judiciary has been considered politicized, and phrases such as “neo-KRS” and “neo-judges” appear in the public debate.

The Ministry of Justice is working on changes to the Act on the National Court Register. The project assumes, among other things, that members of the National Council of the Judiciary will be elected by judges, a Social Council will be established to support the National Council of the Judiciary in carrying out its tasks, and the mandates of judge-members of the National Council of the Judiciary elected after 2017 will expire after the announcement of the results of the elections for new members of the Council.
