In mid -May, the woman was detained by the police in connection with the order to bring her to a prison, because she was convicted by the court for fraud. During the intervention, the police estimated that two young children should be covered by proper care, which is why the Warsaw Family Assistance Center was notified. The four -month -old Oscar and three -year -old Lena went to a foster family. The boy – for unexplained reasons – died a few days later.

The infant's funeral took place at the beginning of June. Magdalena W. took part in a funeral ceremony thanks to the so -called random pass. The officers of the Prison Service escaped her. The woman was handcuffed, her arms and legs, she was dressed in a green prison dress.

Prison Service: Control showed irregularities

The prison service initially explained the legitimacy of such treatment. On Monday, officers issued a message about the initiation of internal control in this matter. On the same day, a message appeared the Director of the General Service of the Prison Service Col. Renata Niziołek, which shows that the control showed irregularities.

“The control team determined that direct coercion measures used by officers, in the form of complex handcuffs, as well as the decision on the obligation to use tax clothing, were disproportionate to the actual degree of threat” – we read in a statement.

It was also noted that “the above application does not change the fact that the officers received information about the expected participation in the ceremony of the sought -after cohabitant and the possibility of its detention by police officers.”

Col. Niziołek pointed out that in the prison service there are procedures that “determine the obligation to inform the prisoner in detail about the method of implementing the permit to leave the penitentiary unit referred to in Article 141a § 1 of the Penal Code.”

The director of the prison may grant the convicted permission to leave the prison under the convoy of a prison officer, assisted by a trustworthy person or independently, for a time not exceeding 5 days, in order to visit a seriously ill family member, participation in the funeral of a family member and in other cases particularly important for the convicted person.

The announcement indicates that “officers have the right to preventive use of direct coercion measures”, but “in each case, however, they should be adequate to the situation and preceded by individualized assessment.”

The General Director of the Prison Service announced that “Service consequences will be drawn to the persons responsible for irregularities”, and the applications from the inspection will be used in the training process.

“The method of implementing permits for participation in funeral ceremonies will be covered by the special supervision of the Central Board of the Prison Service” – we read.

“It is obvious to me that every person, regardless of the legal situation, always deserves empathy, and especially at such a dramatic moment as losing a child” – concluded the message of Colonel Renata Niziołek.

The mother went to prison, children to the foster family

There is a prosecutor's investigation into the death of the infant. It applies to Article 155 of the Penal Code, i.e. inadvertently causing death. So far no one has heard the allegations.

Both the police and the prosecutor's office argue that it was necessary to take children from the family to ensure their safety and proper care. “The situation in their place of residence did not allow them to leave them under the care of people staying there,” prosecutor Karolina Staros, spokeswoman for the Warsaw -Praga District Prosecutor's Office, said on Saturday.

According to a spokeswoman, children could not deal with their great -grandmother because she looked after two other adults at the same time. In turn – as reported in the press release – “the father of children – wanted by the police – refused to come home”.

“This situation, as well as the behavior of the girl during the intervention, gave the grounds to the police to decide to inform the Warsaw Family Assistance Center about the need to provide children with care. Children were placed in an experienced foster family, where they received proper care” – reads the prosecutor's office.

There will be a committee meeting

The Sejm Commission for Children and Youth is to deal with the matter. Its chairwoman Monika Rosa wrote on X that “tragic events in Warsaw related to the death of a 4-month-old child must be explained.” “After consulting the Presidium of the Commission, I convene a meeting of the Commission for Children and Youth in this matter next week,” she informed.

MP of the Civic Coalition announced that the meeting will take place on Wednesday at 13. During the meeting, the Commission will listen to information on securing children in foster care in connection with the death of a child in a foster family. The information is to provide: Minister of Family of Labor and Social Policy, Boss Of the Ministry of Interior and Administrationhead of the Ministry of Justice and the Minister of Equality.
