Natural gas – a new price for bakeries and pastry shops. Voting in the Sejm

The Sejm passed an amendment to the Act on enforcement proceedings in administration. The act includes provisions that enable bakeries and confectioneries to purchase gas at a reduced price – PLN 200.17 per megawatt hour (MWh).

On Wednesday, the Sejm passed an amendment to the act amending the act on enforcement proceedings in administration and certain other acts. 234 deputies voted for, 15 deputies were against, 202 deputies abstained.

Lower gas price for bakeries and reverse VAT charge

In addition to the provisions enabling bakeries and confectioneries to purchase gas at a reduced price, the adopted legal act also provides for the use of reverse charge VAT gas in the gas system, electricity in the power system and services in the field of transferring greenhouse gas emission allowances.

The reverse charge of VAT in these industries will be applied from April 1, 2023 to February 28, 2025.

Changing the definition of remuneration for work

The amendment to the Act on enforcement proceedings in administration and certain other acts is aimed at streamlining activities related to the initiation and conduct of administrative enforcement as well as increasing its effectiveness and introducing solutions that enable the compulsory recovery of receivables related to VAT settled under special procedures. This is especially the case when the place of residence or registered office of the taxpayer subject to the enforcement procedure is in a country other than Poland.

The Act provides for the addition to the catalog of documents constituting the basis for administrative enforcement also a declaration showing the amount due for tax on goods and services submitted in the Member State of identification. It was also proposed to exclude the initiation of administrative enforcement from the obligation to include in these declarations an instruction that they constitute the basis for issuing an enforcement title.

The Act also included a change in the definition of remuneration for work to include remuneration for work and remuneration under other contracts concluded by the employer and the obligated party, also within 12 months from the date of termination or expiration of the employment relationship, and social insurance benefits in the event of sickness and maternity paid by the employer. Recurring claims, which are the only source of income for the obligated natural person, will be subject to enforcement to the extent specified in the provisions of the Labor Code.

The Act also states that in order to simplify the stage of initiating enforcement proceedings and securing pecuniary obligations, it is envisaged to resign from issuing a clause on referring the enforcement title to administrative enforcement and accepting the security order for execution. In addition, it is possible to automatically verify the data contained in the enforcement title with the data contained in the National Court Register.

PGNiG on gas prices for small and medium-sized companies

PGNiG Obrót Retailny, a company from the Orlen Group, announced on Wednesday in a communiqué that it had introduced a new offer that would allow, among others, small and medium-sized enterprises to benefit from the permanent guarantee natural gas prices. “The price offered as part of the offer is currently 33% lower than the base price resulting from the price list for business customers and amounts to PLN 525 per megawatt hour,” the company said.

“We have introduced another solution which, after a temporary reduction in the price list for business customers in January, will be a real support for Polish enterprises. In business, a guarantee of constant fuel prices in the long term, it is crucial, as it facilitates business planning and contributes to the stabilization of the company’s costs, said Henryk Mucha, President of PGNiG Obrót Detaliczny, quoted in the release.

“A fixed gas price may have a positive impact on the prices of products and services offered, in particular, by small and medium-sized enterprises. Customers who have used our price list so far, by choosing our new offer, can secure a price lower by as much as one third by the end of 2025 from the current base price” – stressed Mucha.

It was pointed out that the fixed gas price included in the contract will depend on the moment when a given customer decides to take advantage of the offer. PGNiG Obrót Detaliczny will update it every week so that it is adapted to the current situation on the gas market.
