Neo-KRS believes that the current government is illegal. All because of the use of the word “minister” when taking the oath

The neo-KRS decided to deal with the issue of feminatives. It decided that the use of the feminative by the minister when taking the oath is unconstitutional, and therefore – they are not ministers, but commissioners of government administration departments. Moreover, the neo-KRS concluded that the current government is illegal because “it is not a body identical to the Council of Ministers, as provided for in the Constitution”.

A few days ago, the neo-KRS decided that the use of the feminine by the minister when taking the oath is inconsistent with the constitution, in which the oath formula is precisely described. Therefore, the ladies are not ministers or even ministers. They are not in the government at all, and if they are, then – according to the neo-KRS – they are “commissioners of government administration departments”.

– I think it's absurd, from my perspective, to talk about frivolous things today. We're really focused on the flood. If there are public institutions that don't see that, I can only feel sorry for them – comments the Minister of Education Barbara Nowacka.

Feminatives are common in contemporary language. They emphasize the commitment to the principle of equality in public life. – Legal language, political science language, is also changing, and we cannot expect that a legal act will reflect this language every time – points out Dr. Bogna Baczyńska, a constitutionalist from the University of Szczecin.

According to the neo-KRS, Marzena Okła-Drewnowicz is also not a minister, because she mistyped the name of her position. She said that she was taking over the office of minister for social policy, but she was taking over the office of minister for senior policy.

Neo-KRS undermines the legality of the government

This whole matter leads the neo-KRS to the conclusion that the entire government is therefore illegal. “The Council of Ministers appointed on December 3, 2023 is not a body identical to the Council of Ministers as provided for in the Constitution,” the neo-KRS claims in its position. “The neo-KRS is trying to undermine the institutions of the Polish state,” believes Tomasz Trela, a member of parliament from the Left.

The neo-KRS denies the legality of the Council of Ministers due to the use of the word “minister”. In connection with this, it is also illegal for the government to issue regulations, because there are unauthorized persons in the government. – It not only compromises the neo-KRS, but should actually lead to the termination of this body's activity – comments Krystian Markiewicz, president of the Association of Polish Judges “Iustitia”.

Minister of Funds and Regional Policy Katarzyna Pełczyńska-Nałęcz learned about the whole matter from “Fakty” TVN, while she was in Nysa dealing with post-flood reconstruction. – I don't see any reasons here for the government to be destabilized. I'll say more: for the government to pay more attention to this – the minister comments.

Application to the Constitutional Tribunal

Politicians from the ruling coalition agree that the neo-KRS intentionally wants to introduce chaos. – Ziobro's and Kaczyński's nominees were there only to try to save PiS in difficult situations – says Borys Budka, MEP of the Civic Platform.

The neo-KRS is filing a motion to the Constitutional Tribunal to examine the constitutionality of the establishment of the Criminal Law Codification Commission and in this complaint it contains its revolutionary conclusions. It wants – as it is written – to prevent further unlawful actions of the Council of Ministers in a composition unknown to the Constitution of the Republic of Poland. – Confusing public opinion in order to gain some political benefits – assesses Dr. Bogna Baczyńska.

For now, PiS is reacting with restraint. – From a formal point of view, it was not a rota, which was provided for in the law. I would not be such a formalist – comments Przemysław Czarnek, a member of parliament from Law and Justice.

The Constitutional Tribunal is under the influence of PiS politicians and what happens with the application of the neo-KRS may be a political decision – this is what politicians of the ruling coalition believe. – From the very beginning, it was a body intended to destabilize the situation in Poland – believes Borys Budka. Even if the Tribunal found that the government was not acting legally, the Coalition on October 15 will ignore this ruling – like many previous ones.
