Ombudsman Marcin Wiącek asked the Minister of Health, the prosecutor’s office and the Ombudsman for Patients’ Rights with questions regarding the death of a pregnant 33-year-old woman who was hospitalized in a hospital in Nowy Targ (Małopolskie Voivodeship). Dorota died three days after her waters broke. The immediate cause of death was septic shock. “These reports may indicate that the patient’s rights have been violated,” reads the communiqué of the Commissioner for Human Rights.

On Wednesday Ombudsman (RPO) Marcin Wiącek announced that questions had been sent to the Minister of Health, the prosecutor’s office and the Ombudsman for Patients’ Rights regarding the death of a pregnant patient of the Podhalański Szpital Specyczny im. John Paul II in Nowy Targ.

According to the communiqué of the Office of the Commissioner for Human Rights, the spokesman learned about the case of 33-year-old Dorota, who died as a result of septic shock, from the media. “The ombudsman asks the minister Adam Niedzielski to indicate whether, and if so, what actions the ministry has taken to clarify the situation and to avoid similar events in the future.

From the prosecutor’s office, Wiącek wants to find out “what is the subject of the proceedings and what findings have already been made”. The Ombudsman for Patients’ Rights, Bartłomiej Chmielowiec, asks for information “whether and what actions he has taken to clarify the situation in the hospital.”

The spokesman recalls the circumstances of the tragedy that took place in the hospital in Nowy Targ. She recalls that the 33-year-old went there on May 21, because her amniotic waters began to break.

“Doctors found her anhydrous. Nurses were to tell the patient to lie with her legs above her head, because – as they claimed – thanks to this, water can flow. The patient was to spend the next three days in this position. the inflammation was supposed to develop from Sunday” – we read in the communiqué of the Commissioner’s office.

The Office of the Commissioner for Human Rights points out that – according to media reports based on the words of the patient’s husband – the hospital staff on Tuesday (May 23), i.e. the day before the woman’s death, maintained the hope that the child would be born healthy. “No one informed the patient and her husband that the woman’s condition was bad and her life was in danger” – informs the Ombudsman.

The woman died on Wednesday, May 24, at 9.39. A few hours earlier, doctors had pronounced the death of the fetus. The immediate cause of her death was septic shock.

“These reports may indicate that the patient’s rights have been violated, especially the right to information about health and the right to health services that meet the requirements of current medical knowledge” – indicates the office of the Commissioner for Human Rights. “The media reports also show that in the past, the hospital was allegedly delayed in performing a caesarean section” – we read in the communiqué of the Commissioner for Human Rights. The spokesperson’s office also cites a report according to which this was to be the cause of the woman’s death. “In addition, one of the patients points to the inappropriate behavior of the head of the gynecology and obstetrics department, who was not to inform the patient about her health and addressed her inappropriately” – we read in the release.

Prosecutor’s investigation

On the death of a 33-year-old an investigation is underway, conducted by the Regional Prosecutor’s Office in Katowice.

– There is a team of prosecutors in our prosecutor’s office, it is the so-called “medical errors department”, which deals exclusively with such proceedings. These are really highly qualified prosecutors who conduct only this type of proceedings – assured the spokeswoman of the Regional Prosecutor’s Office in Katowice, Agnieszka Wichary.

Following media reports, the Ombudsman for Patients’ Rights also initiated ex officio investigations.

Three days in the hospital

This was to be the first child of Mrs. Dorota and Mr. Marcin. They got married in September and started building a house. The couple lived in Bochnia, and they came to Podhale to visit Mrs. Dorota’s mother. Then the woman was taken to the hospital in Nowy Targ.

Dorota spent three days in the hospital. Mr. Marcin, husband of the deceased, in an interview with a reporter of the “UWAGA! TVN” program, he recalledthat the doctors throughout almost the entire stay of his wife in the hospital gave her a chance not only to recover, but also to save the pregnancy.

Dorota’s last contact with her family was around 9 pm on Tuesday. At that time, she reported that she felt bad, vomited, had chills.

– The nurse called me this morning that my wife’s condition had deteriorated. She asked to come immediately. I thought that something had happened to the child, but I did not expect it – stressed Dorota’s husband.

– CRP was increasing, i.e. the risk of developing sepsis in the patient was increasing. I don’t know what the doctors were waiting for. On the one hand, perhaps the death of the fetus was awaited, but on the other hand, its condition was not monitored. The ultrasound examination at the admission showed a live fetus, then from what I know from the family, Dorota demanded that the examination be repeated. In the end, the ultrasound was not repeated until her health deteriorated dramatically. This was the last stage of septic shock – said attorney Jolanta Budzowska, who represents Dorota’s family.

After the tragedy, the hospital published short statementin which he announced full cooperation with the investigators and expressed sympathy for the family of the deceased. The management of the hospital also announced that it would not comment on the matter.
