The Ministry of Finance has explained what changes will be included in the amendment to the act on local taxes and fees, which it is currently working on. “Photovoltaic farms are not currently or in the planned solutions listed as subject to property tax,” the Ministry of Finance emphasized in a published statement.

Ministry of Finance announced that the ministry is finalizing work on a draft bill amending the Local Taxes and Fees Act, in a version that takes into account the comments submitted, among others, as a result of public consultations by other ministries, municipalities and entrepreneurs. The purpose of the changes, as the ministry noted, is to clarify the regulations governing the taxation of buildings and structures with real estate tax, while maintaining the fiscal status quo.

Tax on air conditioners, generators and photovoltaic panels. “We haven't considered it”

This means that, on the one hand, taxpayers will not pay higher taxes, while on the other hand, municipal budgets will receive tax revenues at the current level – the Ministry of Finance emphasized. This also applies to the taxation of photovoltaic farms and installations, which, both currently and in the light of the planned solutions, will not be taxed in their entirety, but only on their construction elements – support structures. Photovoltaic farms are not listed as subject to property tax either currently or in the planned solutions – the Ministry of Finance emphasized in a published statement.

It reminded us that during legislative process The Ministry of Finance has informed several times that in order to avoid any doubts as to the scope taxation of photovoltaic farms the issue of taxing only their construction parts will be clearly regulated in the provisions of the Act.

“At no stage of the legislative work did the Ministry of Finance consider taxation air conditioners, power generators and photovoltaic panelsand the dissemination of this type of false information only serves to cause anxiety among entrepreneurs and citizens,” the statement of the Ministry of Finance reads.
