At the Andrzej Duda’s election rally in Nowa Sól, a 20-year-old woman was supposed to shout insulting the president. She was arrested the next day and charged with insulting the head of state. She was sentenced in March, she appealed. The court in Poznań on Tuesday was to issue a verdict in her case, but postponed the announcement of the decision due to the “complexity of the case”.
The case concerns the events of July last year. At that time, President Andrzej Duda, who was seeking re-election, came to Nowa Sól (Lubuskie Voivodeship). His opponents also appeared at the rally. Among them, 20-year-old Wiktoria K. was supposed to be visible, in the film published by Radio West, and in the opinion of the police shouting: “Fuck Duda!”.
Found guilty but not punished
Police from Nowosolsk identified the woman on the basis of this recording. According to “Gazeta Wyborcza”, she was detained at her workplace and taken to the police station, where she was to be questioned as a witness. On the spot, she heard a charge of insulting the head of state, for which she could be sentenced to up to three years in prison.
Whoever publicly insults the President of the Republic of Poland, shall be subject to the penalty of deprivation of liberty for up to 3 years.
In March, the court in Zielona Góra issued a verdict in this case. He found Wiktoria K. guilty of insulting President Andrzej Duda, at the same time withdrew from punishing her, deciding on conditional discontinuation of the criminal proceedings.
He wants an acquittal, the court needs time
The woman appealed against the sentence. Her lawyer demanded an acquittal.
On Tuesday, the case was dealt with by the Court of Appeal in Poznań. Only the prosecutor appeared in the courtroom and requested that the appeal of the defendant’s lawyer be dismissed and the judgment under appeal should be upheld.
The court did not pass the judgment on Tuesday. – The judgment will be announced at 11 am, but on December 13 – said judge Maciej Świergosz from the Court of Appeal in Poznań.
As he explained, the court decided to postpone his release due to the complexity of the case.
Court: was detained wrongly
Meanwhile, in February, the court found that the police had acted unjustly by arresting the 20-year-old. In connection with this, it awarded 1000 zlotys in compensation to Wiktoria K.
