New Sarzyna. Death of a 71-year-old in a swimming pool. Complaint to the lifeguard

The 71-year-old died at the municipal swimming pool in Nowa Sarzyna in Podkarpacie. The District Prosecutor’s Office in Leżajsk has initiated an investigation into this case, which concerns unintentional manslaughter. The 46-year-old lifeguard was charged.

The incident took place on March 15 at the swimming pool of the Municipal Sports and Recreation Center in Nowa Sarzyna (Leżajsk district). According to the investigators, at that time the 71-year-old man was the only person in the pool, and there was also a lifeguard in the same room. – According to the monitoring records, the lifeguard did not pay attention to the man’s problems with staying above the water, he did not take any action to help him – reports Katarzyna Leszczak, head of the District Prosecutor’s Office in Leżajsk.

According to the prosecutor, the man’s body in the water was noticed after about 30 minutes by people who came to use the swimming pool. – Then the man was immediately pulled out of the water and given first aid, an ambulance was called to the scene – informs Leszczak.

Police officers secured the recording from the monitoring, and the body of the deceased was secured for examination. – After an autopsy, the forensic expert gave a preliminary opinion that the cause of the man’s death was not drowning, but cardiac problems. The final opinion on the causes of death will be issued after histopathological examinations have been carried out – says the head of the Leżajsk district prosecutor’s office.

The lifeguard was charged

The prosecutor charged a 46-year-old lifeguard with a crime under Article 160, paragraph 2 of the Penal Code, which concerns the exposure of a person to a direct danger of loss of life by a person who was obliged to take care of a person exposed to danger.

The rescuer – as the prosecutor informs – has not admitted to committing the crime and has refused to give explanations.

The suspect was subject to preventive measures in the form of police supervision, a ban on leaving the country and suspension from the profession of a water rescuer.

The offense of which the rescuer is charged is punishable by up to five years in prison. – Depending on the final opinion of a medical expert as to the causes of death, this charge may change – emphasizes the head of the District Prosecutor’s Office in Leżajsk.
