NIK report on the Justice Fund. Session of a committee in the Sejm, argument, tensions, quarrels between deputies

During the meeting of the justice and human rights and public finance committees, the results of the audit by the Supreme Audit Office on the Justice Fund were discussed. At times, the discussion devoted to this took on a violent course. “Money laundering”, “embezzlement”, “theft” – said opposition politicians, paying attention to the amounts and irregularities indicated by the Supreme Audit Office. – You are trying to spit in the face of crime victims, you are doing it out of pure political interest – replied the minister in the Chancellery of the Prime Minister, Michał Wójcik. NIK President Marian Banaś noted that “the inspection was carried out by very experienced auditors with many years of experience”.

The Wednesday session of the parliamentary justice and human rights and public finance committees was convened at the request of opposition deputies. In the application, information was requested from the ministries of the ministries of justice and finance and the Supreme Audit Office on the results of the Chamber’s audit devoted to the Justice Fund.

The results of this audit were presented by the Supreme Audit Office at the end of September. The actions of the Minister of Justice resulted in wasteful, inadvertent spending of funds from the Justice Fund and favored the emergence of corruption-generating mechanisms – NIK showed. According to the Supreme Audit Office, the irregularities concern over PLN 280 million. The Ministry of Justice strongly rejects these accusations.

This sparked strong opposition from Law and Justice MPs. – Nothing like that has been found in these results – commented the chairman of the justice committee Marek Ast (PiS).

– Listen, 200 million zlotys are spent annually from this fund on equipment that saves lives and health of people, maybe your friends, maybe your relatives. Haven’t you thought about it? You just think there’s a political interest? – Michał Wójcik, minister in the Chancellery of the Prime Minister, responded to the allegations.

– You think that there is only a political interest and that’s all it is about, because your guru Donald Tusk said that Marian Banaś is a crown witness, so today everything must be done to attack the Justice Fund – continued Wójcik. – This is the truth, (…) it pains you that the funds have been transferred through various instruments to support victims of crimes – he added.

As emphasized by the minister in the Chancellery of the Prime Minister, Krzysztof Kwiatkowski was the predecessor of Banas in the position of the head of the Supreme Chamber of Control, who pointed out that “as far as the Justice Fund is concerned, it is impossible to accuse him of being illegal”. “But that was before you started stealing,” the opposition interrupted him with shouts. Wójcik replied: – Perhaps we will meet in court.

– You are doing it out of pure political interest, you are trying to spit in the face of firefighters, children, victims. You play with it – added the minister, addressing the opposition deputies.

Michał Szczerba (KO) pointed out that the opposition’s request concerned information from the Ministry of Justice. – The Ministry of Justice cannot freely interpret who will appear in this case. I understand that the minister from the Chancellery of the Prime Minister, Michał Wójcik, as the vice-president of Solidarna Polska, is very interested in defending his principal, he said. As he added, “there are MPs from Solidarity Poland sitting in this room, direct beneficiaries (…) of this fund, it was organized theft.”

– The only thing stolen was your mind. There is nothing to talk about at all – Wójcik replied in the general chatter of MPs’ voices.

The chairman of Ast said that Wójcik presented the answer, as he was responsible for the scope covered by the control of the Supreme Chamber of Control, when he previously served as deputy minister of justice.

According to the Supreme Audit Office, “the actions of the minister of justice and a significant part of organizations that received subsidies resulted in wasteful and inadvertent spending of public funds, and also fostered the emergence of corruption-generating mechanisms in the case of people making decisions regarding the settlement of funds from the Justice Fund”. The Ministry of Justice described NIK’s accusations as “absurd”.

The Justice Fund collects funds awarded by the perpetrators of crimes. Its subsidies are to be used to support victims who have been injured in, inter alia, traffic accidents as a result of a crime. The funds from the fund are intended to be allocated to legal, psychological and social support for crime victims.
