Notification of prosecutor Ewa Wrzosek in the case of MEP Jacek Decorations from PiS were forwarded to the Regional Prosecutor's Office in Krakow – said a spokesman for the national prosecutor's office. The President of UODO, in turn, notified the prosecutor's office about the unacceptable processing of personal data of Wrzosek, mother of Adam Bodnar, Mariusz KamiÅ„ski and Marek Jakubiak from Kukiz '15.
Both matters resulted after the sudden death of Barbara Skrzypek, a long -time collaborator of the PiS president JarosÅ‚aw KaczyÅ„ski. Three days before the death, which took place on March 15, the violinist was questioned as a witness in the Warsaw District Prosecutor's Office in the investigation of the Silver company associated with PiS and the would -be investment “Two Towers”.
The autopsy of Barbara Skrzypek showed that the cause of her death was a vast heart attack. The District Prosecutor's Office in Warsaw stated that the violinist did not raise any objections as to the form and length of the interrogation, and in addition to reading problems without glasses, it did not report health ailments. The proceedings in the case of unintentional causal of the violinist is conducted by the Warsaw-Praga District Prosecutor's Office under the supervision of the National Prosecutor's Office.

PiS politicians, including the party leader, believe that there is a relationship between the interrogation of a woman and her death. On Wednesday, the prosecutor's office revealed a written justification for the decision to prevent the representative of Barbara Skrzypek to the interrogation. The decision was justified, among others in the fact that in the preparatory proceedings the prosecutor may refuse to allow a representative to participate in the proxy's proceedings, if he finds that he does not require the defense of the interests of a person who is not a party.
In this justification, it was indicated, among others, that Barbara Skrzypek gave testimony as a witness and “a procedural decision that would end the preparatory proceedings, in no way will lead to a substantive decision regarding the person of Barbara Skrzypek, in particular in the scope of her criminal liability.”
Notification of suspected punishable threats
Prosecutor Wrzosek submitted a notification of a reasonable suspicion of committing a crime of criminal threats by PiS Jacek MEP Decoration. This notification also went to the National Prosecutor's Office.

Wrzosek informed that she had submitted a notification to the national prosecutor in this case. The prosecutor also applied for proceedings regarding the circumstances of obtaining this document “in an unlawful way” and examining the issue of causing a possible threat to a public official. – Revealing information about such a degree of detail can be used to use it in a way that poses a threat to my and my loved ones' safety – she assessed.

As noted, the entries of which the notification relates included, among others: names, maiden surnames, dates of birth, PESEL numbers, residence addresses, marital status, citizenship, education, belonging to political organizations, parents' names, then ID numbers and special characters and a place of registration, as well as data on the spouse.
“Some of the people whose data have been disclosed in the manner described above perform public functions, which is why their personal data in a certain extent – name and surname – are public and constitute public information. However, the other information belongs to the sphere of their privacy” – UODO pointed out.
“Particularly socially harmful”
In the opinion of the Office, “the shared scope of personal data clearly identifies the persons to whom the data relate, causing the risk of violating the rights or freedoms of these people.” “Access to this data by unauthorized persons may give birth to the risk of, e.g. theft or falsification of identity, financial losses, violations of a good name or loss of confidentiality of personal data. In situations that apply to some people performing public functions, these activities also created a risk of threat to their security, as in the case of the prosecutor” – assessed.
As UODO emphasized, actions consisting in the unacceptable processing of this data “seem particularly socially harmful and deserve the reaction from the relevant law protection authorities”. “It is not only an unprecedented activity that violates the privacy of such people, but above all that give birth to the risk of violating the elementary life interests of their and their families, such as possible acts of violence and aggression targeted at life and health,” UODO assessed.
Pursuant to the Personal Data Protection Act, who processes personal data, although their processing is not permissible or is not entitled to their processing, it is subject to a fine, the penalty of restriction of liberty or deprivation of liberty for up to two years.
UODO in the Thursday communication reminded that the processing of personal data is in line with the law only if: the data subject has agreed to their processing in one or more specific purposes; Processing is necessary to protect the vital interests of the data subject or another natural person; Processing is necessary for the purposes arising from legitimate interests pursued by the administrator or by the third party.
